CrazyRussianHacker, Plagiarist and DMCA abuser! #WTFU
.youtube.com/results?search_query=fair+use // .youtube.com/results?search_query=DMCA // So when I first made a video showing that CrazyRussianHackers idea about using dry ice for an air conditioner was basically suicidal, I really didnt think anything would come of it. Then recently he filed a DMCA takedown of my video. This resulted in a strike against my account and me losing access to certain features.

Now thats a special brand of idiot who makes a video about a suicidal way to chill the air, then files a baseless copyright takedown of the only warning about how dumb that idea is. Especially against a guy like me who has a history of fighting DMCA abuse! [ people have yet to be sued in court for DMCA abuse, it is a felony ]

A Public Service To The Industry From Attorney Marc Randazza « MikeSouth.Com
In this article, I write about how “morality” has been used to deny intellectual property rights worldwide. The adult entertainment industry should take note, because its ability to protect both its copyrights and its trademarks, world wide, are discussed in this article. If you run an adult entertainment business or frankly, any business that could find itself targeted by moralizers, you should download the article and keep it in your library.

Online pirates could face 10 years in jail - BBC News
The proposed measures are mainly targeted at the distributors of pirated content - the people creating copies of movies, sometimes before release, and uploading them to be downloaded by thousands upon thousands. It's not, the police are clear to point out, aimed at small-time downloaders - although there are other ways and means to prevent that too. The consultation phase will likely turn heated. Internet rights groups will question the influence Hollywood and the music industry has over the day-to-day operations of the police - after all, industry bodies, funded by top studios and record labels, have paid for staff to work in police stations with the sole brief of investigating copyright crime. They'll also say the way to "solve" online piracy is to offer affordable, flexible ways to consume new film and music - not jail terms.

Apple reportedly plays dirty to kill Spotify’s free tier — and I hope it gets away with it | PandoDaily
[ Apple's Might. History Rhymes. ] There’s a report out that Apple is pushing music labels to “force” Spotify to abandon its free, ad-supported tier. As Apple prepares to gather the ashes of Beats Music and relaunch its own streaming music service — which sources say will likely to be paid-only — this gambit would decimate Spotify’s user base from 60 million total users to only 15 million paid users. Moreover, sources told the outlet that if Universal Music Group removed its catalog from YouTube, Apple would pay the licensing fee the label conglomerate receives from that platform. (YouTube also has a streaming service in the offing). Considering Apple’s ability to preload apps onto new versions of iOS — not to the mention the fact that it already has 800 million credit cards on file and so only needs to convince a tiny portion of them to sign up in order to beat Spotify — the move would be an effective knockout punch for Apple in America’s streaming music fight.

Death to remixes: The enormous hidden threat of Soundcloud’s ZEFR partnership | PandoDaily
And Stuckey isn’t alone. Two days ago, remix artist DJ Cotton said on Twitter that SoundCloud removed 30 of his uploads due to copyright infringement. And some DJs have talked of abandoning SoundCloud altogether thanks to its ramping up of copyright enforcement. Legally speaking, it would appear that SoundCloud has every right to take down this copyrighted material, but the matter is not so clearcut. The legality of remixes and mashups has always been precarious, relying on a fair use doctrine that is vague by design. The work must be sufficiently “transformative” to avoid violating copyright law, but that distinction is subjective and can only be made by a judge, not a piece of software like the one used by ZEFR.

Latest TPP Leak Reveals Even Harsher Copyright Rules - Forbes
The US is also calling for criminal sanctions for copyright infringement, even where the infringement isn’t being carried out for commercial reasons. “If the US gets its way, then criminal penalties will apply even against users who were not seeking financial gain from sharing or making available copyrighted works, such as fans and archivists,” write Jeremy Malcolm and Maira Sutton of the Electronic Frontier Foundation (EFF). “Such a broad definition is ripe for abuse.” Indeed, a similar provision in a free trade agreement between Columbia and the US led to copyright laws that saw a Columbian graduate student arrested for posting another student’s academic paper online without permission.

Those YouTube Promo Plans Are A Lot More Common Than You Might Think
But it's something of a necessary evil, he continues. With copyright issues and the struggle to remain relevant amongst the sea of other YouTubers trying to get their Let's Plays noticed, a cushy bonus like a few extra bucks per thousand views could feel like a good deal. And so Boogie warns to take the videos you see with a grain of salt, because these kinds of deals are fairly widespread within the community. And despite many of these contracts necessitating a disclosure of the agreement in the descriptions of these videos, not every YouTuber is as open about the deals they make, Boogie says.

+ http://www.digitaltrends.com/mobile/how-to-improve-music-streaming/ + http://www.spin.com/articles/music-documentaries-netflix-best-streaming-movies/ + Internet Radio Stations (Amazingradio, Capitalxtra).

"Fair use" generates trillions in the US alone
The method is similar to that used in several prominent piracy studies; in this case, the "fair use" industries are divided into "core" and "non-core" companies, depending on how important fair use is to their very existence. Economic activity and payroll numbers can then be crunched from this data, offering a rebuttal to any view of fair use that sees it as a mere afterthought in copyright law, one good for protecting YouTube parodies but not much more.

The CCIA report's numbers are staggering. The "fair use economy" accounted for 23 percent of all US real economic growth between 2002 and 2007. Fair use industries (core and non-core combined) generated $4.7 trillion in 2007. And "about one out of every eight workers in the United States is employed in an industry that benefits from the protection afforded by fair use."
