The ongoing legal saga known as the Oracle-Google copyright battle took a huge leap Wednesday when Oracle claimed the last six Android operating systems are "infringing Oracle's copyrights in the Java platform." That's according to the latest paperwork Oracle filed in the five-year-old closely watched case that so far has resulted in the determination that Application Programming Interfaces (APIs) are, indeed, copyrightable. [...] The latest legal brouhaha comes two months after the Supreme Court declined to review Google's contentions that assigning copyright to APIs, sets a dangerous precedent and allows "copyright monopolies over the basic building blocks of computer design and programming." Mr. Ellison and Mr. Hurd, meanwhile, have been close personal friends.

Mr. Ellison’s attack on the H.P. board focused on questions of corporate governance.

“In losing Mark Hurd, the H.P. board failed to act in the best interest of H.P.’s employees, shareholders, customers and partners,” Mr. Ellison wrote. “The H.P. board admits that it fully investigated the sexual harassment claims against Mark and found them to be utterly false.”

The H.P. investigation failed to turn up evidence of sexual misconduct by Mr. Hurd, and both he and Jodie Fisher, a 50-year-old actress whom H.P. had hired to work at marketing events, have denied having a romantic relationship.

Ms. Fisher has since settled the matter with Mr. Hurd for an undisclosed sum.

H.P. has said that Mr. Hurd’s resignation was the result of a break in trust caused by his falsifying expense reports to conceal the relationship.

What Happens When Apple Passes Microsoft In Value? Yes, When.
Apple has soared past HP, Oracle, IBM, and most recently, Google, to move into the top five most valuable companies in the U.S.

Here’s the real problem for Microsoft though. If Apple does in fact pass Microsoft in market cap, I can see CEO Steve Ballmer losing it, and that could steal his focus away from what should still be considered his real enemy: Google. It is Google, after all, that is directly attacking the core Microsoft brands, Office and Windows, where the company makes practically all of its money. Google Apps and Chrome OS are meant to do two things: Kill Office and kill Windows.

While the voluminous deal activity has meant a bonanza for shareholders -- many software stocks have soared this year, partly because of the hot merger landscape -- Mr. Gonick's experience highlights the flip side: As the big software companies flesh out their integration plans internally, customers on the outside are left with unanswered questions about their future.

But that isn't the only thing that has changed in recent years. Today, many of the companies being acquired aren't start-ups. They're established, profitable companies with a slew of customers.

This has left CIOs and information technology departments with less influence in negotiating software discounts because there are fewer vendors to pit against each other at the bargaining table, though customers can also potentially lower maintenance and integration costs by buying more software from a single vendor, says Eliot Colon, chief operating officer at Miro Consulting Inc., a software-licensing consultancy in Fords, N.J.

In addition, Oracle would spend more than $72 million over the next three years in research and development to improve and refine MySQL, which Oracle said was more money than Sun had been spending on developing the program.

In a statement, Ms. Kroes added that she believed the commission’s review would have “a satisfactory outcome.”

Not everyone was persuaded that the concessions were sufficient. Florian Müller, an open-source programmer in Starnberg, Germany, called them “a good starting point.”

“The real question is whether Oracle is going to continue to develop MySQL in a meaningful way that responds to market needs,” he said. “They have in my opinion an inherent conflict of interest in not innovating a product that would detract from their commercial databases.”
