If these Canadians lived in the United States, how would they protect their privacy? (Bennett, 2017)
This paper contributes to the debate about the adequacy of the United States’ fragmented, networked, federal system of privacy protection, an outlier among modern industrialized Western democracies, by taking the perspective of an individual seeking redress for privacy invasions. We analyze five actual privacy cases from the Canadian private sector, investigated by the Privacy Commissioner of Canada, and examine whether the privacy “wrong” experienced by Canadian complainants would be illegal in the U.S., how an individual would proceed with a complaint and what the outcome might be.

Canadian Heritage: The Library and Archives Canada Staff Resource Centre closed on Nov. 1, 2012. As of April 2013, the Public Service Commission (PSC) was in the process of closing. Plans regarding the disposition of PSC's library collection had not been finalized.

Citizenship and Immigration (CIC): The CIC library closed on March 31, 2012.

Environment Canada: The National Roundtable on the Environment and the Economy was eliminated. Its library was closed on March 31, 2013.

Foreign Affairs: The Documentation Service and library of the Canadian Cultural Centre at the Canadian Embassy in Paris closed on June 21, 2012.

Human Resources and Skills Development: HRSDC closed its libraries in Gatineau, Quebec, and Montreal on March 31, 2013.

National Capital Commission: The National Capital Commission Library closed in 2012.

Intergovernmental Affairs: The Transportation Safety Board of Canada (TSB) is expected to significantly reduce and eventually close its library.

Public Works and Government Services: PWGSC closed its library on May 31, 2012.

Transport, Infrastructure and Communities: Transport Canada closed its library in 2012.


Canada Revenue Agency (CRA): The CRA is consolidating its nine existing libraries into one, the location of which has yet to be determined.

Environment Canada: Parks Canada will consolidate five libraries into one. Regional libraries located in Calgary, Winnipeg, Quebec City and Halifax will be consolidated into the Cornwall, Ontario location.

Fisheries and Oceans (DFO): The DFO will close seven of its libraries, leaving two principal and two subsidiary locations. Consolidation completed September 2012.

Natural Resources: Natural Resources Canada is set to close six of 14 libraries in 2012-2013: two in Ottawa, one in Varennes, Quebec; one in Edmonton, Alberta; and another in western Canada. In 2014, another Ottawa library will be closed.

The Arctic seabed is known to contain large quantities of oil, natural gas, and mineral resources. Resource development is frequently associated with conflict, both in media articles and scholarly works. Such writings encourage us to associate resource development with conflict and zero-sum politics, with a race to stake claims and a proliferation of military and naval activities in support of assertions of sovereignty.[1] Predictions of impending armed conflict over Arctic seabed resources, while less prevalent than the fearmongering of several years ago, are still prevalent.[2] Yet contrary to such dire predictions, the delineation of extended continental shelves in the Arctic is proceeding in an orderly, cooperative fashion.

"The information leaked by Edward Snowden about the U.S. National Security Agency (NSA)’s data collection programs is driving a nation-wide debate in America over the future of privacy and national security. Americans, however, are not the only ones who should be considering the consequences of the NSA’s activities. Other countries, including Canada, operate similar surveillance programs and participate in national security data sharing partnerships that crisscross the globe. Given this reality, and the fact that much of Canadians’ online data flows though servers located in the U.S. where it is not subject to any Fourth Amendment protection, we think the tenor of the privacy-security debate within Canada is too quiet. Expanding the debate will require engaging more Canadians with what we know and don’t know about surveillance in Canada. To this end, here is a modest exploration of what we’ve learned since the Snowden story broke."
