The Article challenges the basic premise in the law of partisan gerrymandering that government partisan purpose is constitutional at all. The central problem, Justice Scalia once explained in Vieth v. Jubelirer, is that partisan gerrymandering becomes unconstitutional only when it “has gone too far,” giving rise to the intractable inquiry into “how much is too much.” But the premise that partisanship is an ordinary and lawful purpose, articulated as settled law and widely understood as such, is largely wrong as constitutional doctrine. The Article surveys constitutional law to demonstrate the vitality of an important, if implicit norm against government partisanship across a variety of settings. From political patronage, to government speech, to election administration and even in redistricting itself, Vieth is the exception in failing to bar tribal partisanship as a legitimate state interest in lawmaking. The puzzle therefore is why the Supreme Court in Vieth diverged from this overarching norm for legislative redistricting where the need for government nonpartisanship is most acute and so rarely met. The Article proposes a purpose-focused approach that identifies partisanship as an illegitimate basis for lawmaking and requires the government to justify its redistricting with reference to legitimate state interests beyond partisanship, irrespective of extreme partisan effects. The importance of consolidating and reifying the norm against government partisanship, in its most salient legal context, cannot be overstated at a time when hyperpolarization between the major parties dominates national politics and is at its most severe in our lifetime.

This article aims to correct the widespread imbalance in contemporary liberal thought, which makes explicit appeal to the "least advantaged" without parallel attention to the "most advantaged" as a distinct group in need of regulatory attention. Rawls's influential theory of justice is perhaps the paradigmatic instance of this imbalance, but I show how a Rawlsian framework nonetheless provides three justifications for why implementers of liberal justice—above all, legislators—should regulate the economic prospects of a polity's richest citizens: as a heuristic device for ensuring that a system of inequalities not reach a level at which inequalities cease being mutually advantageous, as protection against excessive inequalities threatening civic liberty, and as redress for a liberal society's inability to fully realize fair equality of opportunity with regard to education and politics. Against the objection that such arguments amount to a defense of envy, insofar as they support policies that in certain instances impose economic costs on the most advantaged with negative or neutral economic impact on the rest of society, I attend to Rawls's often overlooked distinction between irrational and reasonable forms of envy, showing that any envy involved in the proposed regulation of the most advantaged falls within this latter category. - downloaded via iphone to dbox

We document a divergence in the duration of rule for monarchs in Western Europe and the Islamic world beginning in the medieval period. While leadership tenures in the two regions were similar in the 8th century, Christian kings became increasingly long lived compared to Muslim sultans. We argue that forms of executive constraint that emerged under feudal institutions in Western Europe were associated with increased political stability and find empirical support for this argument. While feudal institutions served as the basis for military recruitment by European monarchs, Muslim sultans relied on mamlukism—or the use of military slaves imported from non-Muslim lands. Dependence on mamluk armies limited the bargaining strength of local notables vis-à-vis the sultan, hindering the development of a productively adversarial relationship between ruler and local elites. We argue that Muslim societies' reliance on mamluks, rather than local elites, as the basis for military leadership, may explain why the Glorious Revolution occurred in England, not Egypt. - downloaded via iphone to dbox

Theoretical work on taxation and state-building borrows heavily from early modern European experience. While a number of European states increased centralized tax revenues during this period, for others revenues stagnated or even declined and these variations have motivated alternative arguments for the determinants of fiscal and state capacity. This study reviews the arguments concerning the three determinants that have received most attention, namely warfare, economic structure, and political regime, and tests them by making use of a new and comprehensive tax revenue dataset. Our main finding is that these three determinants worked in interaction with each other. Specifically, when under pressure of war, it was representative regimes in more urbanized-commercial economies and authoritarian regimes in more rural-agrarian economies that tended to better aggregate domestic interests towards state-building. - Downloaded via iphone

Do big cities exert more power than less populous ones in American state legislatures? In many m m political systems, greater representation leads to more policy gains, yet for most of the nation's history, urban advocates have argued that big cities face systematic discrimination in statehouses. Drawing on a new historical dataset spanning 120 years and 13 states, we find clear evidence that there is strength in numbers for big-city delegations in state legislatures. District bills affecting large metropolises fail at much higher rates than bills affecting small cities, counties, and villages. Big cities lose so often because size leads to damaging divisions. We demonstrate that the cities with the largest delegations—are more likely to be internally divided—are the most frustrated in the legislative process. Demographic differences also matter, with district bills for cities that have many foreign-born residents, compared the state as a whole, failing at especially high rates. -- Downloaded via iphone

Ideology has been the subject of a surprising amount of attention during the last half of the 20thC. Although it has been argued that the term has been "thoroughly muddied by diverse uses"(Converse 1964, 207),an empirical investigation of the pages of the Review reveals substantial convergence among political scientists over time on a core definition. This essay traces the use of the concept in the Review since its launch in 1906. It reveals changing fashions in the connotation of the term, but suggests an underlying agreement on the essential components - coherence, stability and contrast - and underlines the centrality of the concept of ideology in political science. - Downloaded via Air

Abstract
Does democracy encourage free trade? It depends. Broadening the franchise involves transferring power from non-elected elites to the wider population, most of whom will be workers. The Hecksher-Ohlin-Stolper-Samuelson logic says that democratization should lead to more liberal trade policies in countries where workers stand to gain from free trade; and to more protectionist policies in countries where workers will benefit from the imposition of tariffs and quotas. Abstract
This paper analyses drivers of imports during the major world trade collapses of the Great Depression (1930s; 34 countries) and the Great Recession (1930s; 173 countries). The analysis deals with the first year of these episodes and develops a small empirical model that shows a significant impact of the development of GDP, the share of manufacturing goods in total imports and the political system. WZB Berlin Social Science Center Discussion Papers, SP IV 2015-808, 2015 - Developing a sociological informed social theory perspective, this article asks the question why social praxis’ of justification has moved to the centre-stage within the debate on transnational ordering. In contrast to perspectives which see the relationship between national and transnational forms or ordering as characterised by a zero-sum game, the coevolutionary and mutually reinforcing relationship between national and transnational forms of ordering is emphasised. It is, moreover, argued that this complementarity can be traced back to the fundamentally different function and position of national and transnational forms of ordering in world society. The widespread attempt to analyse transnational developments on the basis of concepts of law and the political which emerged in national contexts are therefore seen as problematic. Instead context adequate concepts of transnational law and politics are needed. It is on this background, that a discourse on justification has emerged in relation to transnational settings. Transnational justificatory praxis’ can be understood as functional equivalents to democracy in transnational settings in so far as both can be understood as reflexivity increasing instruments. The central difference is, however, that democratic frameworks implies an ex ante form of the political in contrast to the ex post emphasis of justificatory praxis’. Journal for Communication and Culture 1 (2):99-110 (2011) -- This paper proposes a turnover to the theories which have fostered the 20th Century discourse upon the public sphere. By depicting the way in which the structural transformations suffered by the public sphere within the framework of modernity have been theorized by the pre-Habermasian discourse upon the public sphere, the present work aims at revealing the similarities as well as the differences between John Dewey‟s approach of the public sphere and Hannah Arendt‟s theory of the political realm. Although Arendt was not so much influenced by pragmatism, their theories share a normative dimension according to which the public sphere is structured in order to achieve certain functions, which were disrupted in modernity. Therefore Dewey‟s eclipse of the public, through the multiplication of its content, corresponds to Arendt‟s decay of the public realm through the rise of the social. -- Keywords Arendt Dewey modernity decay public sphere plurality political sphere

New Literary History (2014) - My aim in this essay is to elaborate a mode of political theorizing that is not beholden to the “how do you know?” question. Rather than focusing on epistemic arguments, I propose that people interested in studying political theory address the partiality of aspects that emerge when engaging works, and the participation of media in the creation of political concepts. Central to my elaborations is the aesthetic notion that there is no overarching rule that will determine how objects, peoples, and events relate to one another and stand out as relevant to political theory, and that there are no necessary qualifications for participation in political theorizing. The essay is comprised of three sections. The first engages three thinkers of the interpretive turn in political theory: Charles Taylor, Quentin Skinner, and James Tully. The second section assembles three images of thought drawn from three different expressions of three diverse thinkers: Roland Barthes, Stanley Cavell, and Jacques Derrida. In the third section I depart from the theoretical experimentation and interpretive work of the previous sections and redirect attention to the participation of media in political theorizing. The debate between Bob and us centers on a simple question: what happens if we fund the formal parties in the same way we fund the shadow parties (the Super PACs and 501(c)(4) and (c)(6) organizations)? Our worry is that if the formal parties’ financing is identical to that of the shadow parties’, this will gradually transform the formal parties into institutions that look more like the shadow parties—hierarchical, almost entirely beholden to big donors—thus seriously eroding what remains of a reasonably pluralistic party system. Bob’s worry, on the other side, is that if we don’t do something to level the playing field between the formal parties and shadow parties, the formal parties don’t have much of a future in politics.

Tabetha Ewing's Rumor, Diplomacy and War in Enlightenment Paris (Oxford University Studies in the Enlightenment, 2014) is all about the on dit, the word on the street that everyday Parisians might have picked up, and/or spread around town in the 1740s. Focused on rumor during the War of Austrian Succession that lasted from 1740-1748, Ewing's is a book that examines a range of urban voices and opinions across a pivotal decade of the Enlightenment. Taking very seriously the landscapes of gossip and fantasy, Rumor, Diplomacy, and War is intriguing in its subject matter and its methodology. Interested in the circulation of speech and ideas, Ewing tracks a variety of bruits–open and clandestine media, royal efforts to release and police information about matters of state and military conflict, and oral and written forms of communication. All this, with the aim of exploring a distinctively early-modern brand of political participation, and an "inchoate citizenship" that existed in the decades before the French Revolution. Questions of national identity, loyalty to the regime (or not), and political expression/representation were in the air during these years of war and Enlightenment. Ewing's is a book that shows us how much historians can hear if we listen carefully.

The paper advances an analytical rendering of populism and argues that the components that make it a recognizable phenomenon are simplification and polarization of political divisions in the view of achieving a deeper unification of the masses against the existing elites and under an organic narrative that most of the time a leader embodies. Populism is thus internal to and a challenge of representative democracy; it competes with it on the meaning and practice of representation since aims at a more genuine identification between the represented and the representatives. Democracy requires a commitment to the public good. But for a long time now, our citizens have been taught to see themselves as only private actors. -- What that experience has taught me is that the purpose, challenge, and substance of education in a democracy are defined by two questions: How ought we to live, side by side, not as lone individuals but as citizens? And how can we, through education, help individuals answer that question? Answering these questions is hard, particularly in the United States, where many seem to view citizenship as a burden and even an unfortunate necessity. The rampant distrust of government and the public sector has become overwhelming. We sidestep the question and defend education in purely economic terms, linking education to work and productivity. Nonetheless, citizenship is more than economic; it is a defining political fact of life, one that even in its neglect can’t be dismissed. And active citizenship, embraced with some measure of critical enthusiasm, may be an indispensable foundation of justice, freedom, and civility. -- Leon Botstein is president of Bard College, music director of the American Symphony Orchestra, and editor of The Musical Quarterly. not so long ago (the EU) was praised by some as a model of ingenious institutional innovation and cooperative transnational governance, while simultaneously denounced by others as an insidious instrument for subjecting ostensibly democratic states to the imperious dictates of capitalism in its latest “neoliberal” form? For 2 generations after World War II, memories of the devastating consequences of nationalism trumped economic rivalries, giving technocrats maneuvering room to devise continental strategies for economic growth that nevertheless enabled member states to maintain sufficient control over social policy to satisfy voter demands. For decades, this arrangement held.By the mid-1980s, however, enormous changes in the global economy forced the European Community to reinvent itself in order to remain competitive. The original balance between national sovereignty and technocratic government at the European level was altered, limiting the ability of member states to set their own economic policy. But today’s convergent crises raise the question of whether the European Union that replaced the European Community needs to reinvent itself yet again. And if so, is reinvention possible at a time when many Europeans, and especially those for whom World War II is a distant memory, feel that the EU is exacerbating nationalist enmities rather than calming them? -- downloaded pdf to Note

Joseph Fishkin, University of Texas School of Law -- Heather Gerken, Yale University - Law School -- McCutcheon v Federal Election Commission can only be understood against the deep shifts taking place in American politics. By some measures, party identity is very strong, and the Democratic Party and the Republican Party are at the height of their power. Other measures suggest that the parties are losing their grip on politics to “outside groups” (..) which have taken over a startling array of core party functions. But these “outside groups” are are deeply and durably aligned with one party or the other and run by consummate party insiders. That’s why we call them shadow parties.(..) What we are witnessing is not outside spenders pulling power away from the parties but an intraparty battle for the heart and soul of the party writ large. Although we see this battle as an intraparty fight, its likely outcome is one that “small-d” democrats ought to find disquieting. The parties have been important sites of pluralist competition. The shift toward shadow parties threatens to flatten the party structure and inhibit pluralist politics. (..) They are closed to most and controlled by few. We are especially concerned that the shift to the shadow parties will permanently squeeze out the party faithful – the activists and highly engaged citizens who serve as a bridge between everyday citizens and political elites – and largely eliminate their already-diminished role within the party writ large. ...what looks like constitutional dysfunction is actually constitutional transition, (..)Americans last experienced this sense of dysfunction during the late 1970s and early 1980s (..) the transition to a new constitutional regime will be far more difficult than those effected in 1932 and 1980. (1) the growth of the modern state and changes in the role of the presidency mean that even the most politically adept and fortunate presidents face greater obstacles to implementing transformative change than they once did; they are less able than past reconstructive leaders to disrupt existing institutions and clear the ground for a new politics. This, by itself, does not prevent the emergence of a new constitutional regime. But (2) the current transition will be especially difficult because we are near the peak of a long cycle of increasing polarization between the nation’s two major political parties. That polarization greatly raises the stakes of a transition to a new constitutional regime. The defenders of the old order have every incentive to resist the emergence of a new regime until the bitter end. A long and frustrating transition will have important side effects. (1) a dysfunctional Congress tempts the Executive to act unilaterally, (..). Future presidents may use these new sources of power even when the period of dysfunction has passed. (2) sustained political dysfunction also tends to empower the judiciary vis-à-vis Congress. Moreover, judges appointed by the older dominant party, late in the regime, are less likely to engage in judicial restraint and more likely to push the jurisprudential envelope. A bunch of great Qs from HB -- I recently spoke with Sam Issacharoff (NYU Law School) about his new book, Fragile Democracies: Contested Power in the Era of Constitutional Courts (CUP). -- JB: You are one of the foremost experts on American election law. How did you get interested in the constitutional problems of emerging democracies? JB: A key claim of the book is that courts can play an important role in keeping emerging democracies from backsliding into authoritarianism and dictatorship. Why are courts able to do this? -- JB: Critics of judicial review have long argued that it is inconsistent with democracy, and actually undermines it in the long run. How does your argument engage with those critics? SI: We have long debated the issue of judicial review and the countermajoritarian difficulty in the U.S. The new democracies of the 20thC and 21stC uniformly created constitutional courts whose central function was to check the exercise of power by the political branches(..) entrusted to these courts not only the power of judicial review, but the power to be the central administrative body over elections. The gamble is that democracy would be stabilized by guaranteeing limitations on government and repeat elections. (..) I would prefer to see the question whether strong court constitutionalism can sustain democracy in fractured societies as an empirical one-- of "does it work?" If it does, we can indulge the theoretical question of the legitimacy of how judicial power is exercised, but down the road a ways.

The equality model: On this model, each party member should have equal influence over the direction of the party. 2. The elite-driven model: On this model, the parties are not democracies; they are more like firms, competing in the broader democratic arena. In this analogy, party elites are the executives; the donors are the shareholders; and ordinary voters are like consumers who can accept or reject what the elites are selling. This model has its roots in a Schumpeterian conception of democracy. -- Neither of these models, we think, is adequate—either positively or normatively. (..) So we propose 3. The pluralist model: This hybrid model takes into account the party’s multi-layered role in our politics. On this model, the party stands in part for ordinary voters who make up the base of the party, in part for the party elites who run it, and in part for the activists in between—the party faithful, who knock on doors and show up at rallies and caucuses and provide much of the party’s energy. The party faithful are much more heavily involved in the party than ordinary voters, but much less influential than the Koch brothers. One major worry we have about the shift from official parties to shadow parties is that the party faithful may get squeezed out, leaving us with a politics that is more centralized and broadcast-like.

Jonathan Rauch's paper “Political realism: How hacks, machines, big money and back-room deals can strengthen American democracy” marks the beginning of a serious effort on behalf of Brookings scholars to open up a conversation challenging the reform assumptions of the past few decades. In the coming months we will be convening social scientists and public intellectuals along with politicians and activists in order to explore a new way of looking at solutions to the polarization of contemporary American politics. Not everyone will agree—with Rauch—or with each other. But we feel the time has come to take on the conventional reform wisdom and begin an intellectual dialogue on why our democracy seems to be failing. Taking a page from international relations where realism assumes conflict among nations; political realism also assumes that conflict is a constant part of the system. According to Rauch realism, “…sees governing as difficult and political peace and stability as treasures never to be taken for granted.” He goes on to argue the virtues of transactional politics and to point out how, in the name of reform, weakening the bulwarks of transactional politics has weakened democracy as a whole. “Where the realist tends to believe that governing is inherently difficult, that politics is inherently transactional and that success is best judged in terms of reaching social accommodation rather than achieving some abstract purpose, the progressive tends to see government as perfectible and politics as a path toward a higher public good.” In practice this means that the political realist advocates things that have been anathema to reformers. -- downloaded pdf to Note

Citizen participation has undergone a radical shift since anxieties about "bowling alone" seized the nation in the 1990s. Many pundits and observers have cheered America's twenty-first century civic renaissance-an explosion of participatory innovations in public life. Invitations to "have your say!" and "join the discussion!" have proliferated. But has the widespread enthusiasm for maximizing citizen democracy led to real change? Sociologist Caroline W. Lee examines how participatory innovations have reshaped American civic life over the past two decades. Lee looks at the public engagement industry that emerged to serve government, corporate, and nonprofit clients seeking to gain a handle on the increasingly noisy demands of their constituents and stakeholders. The beneficiaries of new forms of democratic empowerment are not only humble citizens, but also the engagement experts who host the forums. Does it matter if the folks deepening democracy are making money at it? How do they make sense of the contradictions inherent in their roles? In investigating public engagement practitioners' everyday anxieties and larger worldviews, we see reflected the strange meaning of power in contemporary institutions. New technologies and deliberative practices have democratized the ways in which organizations operate, but Lee argues that they have also been marketed and sold as tools to facilitate cost-cutting, profitability, and other management goals - and that public deliberation has burdened everyday people with new responsibilities without delivering on its promises of empowerment.

21 page article -- Explains why "rational choice" fails as explanatory theory in lots of collective action, public opinion, game theory, etc. -- domains where decisions to act aren't based exclusively on instrumental, consequentialist, cost-benefit calculative, and egoistic (directly concerned with impact on self) forms of, and context for, reasoning. Boudon finds "rational choice" superior to hand-wavy explanations that are speculative "black boxes" -- e.g. (1) sociobiology or evo-devo that we're hardwired, (2) Kahneman and Tversky heuristics and biases -- fascinating observations but aren't explanatory, (3) social/cultural explanations such as "socialization" which are tautological or a black box that provide no mechanisms that can differentiate situations or variations in outcomes. E.g. in Roman Empire peasants were more likely to remain pagan and soldiers were more likely to be attracted to the new religion. "Socialization" doesn't explain why soldiers raised in the traditional religious milieu and belief system were more likely to change their beliefs. Great examples of how rationality includes cognitive processes dealing with (1) non-instrumental contexts - e.g. identification with communitarian concerns ranging from voting to immigration policies, (2) aligning actions with one's judgment of what's more likely "true" based on core beliefs and how one has learned to evaluate "evidence" [e.g. Swedes are even more likely to reject "lump of labor" than Americans!] (3) axiological reasoning, including norms of fairness that may be fairly universal (e.g. reaction to Antigone, ultimatum game) or specific to a culture (e.g. due process in political application of "rule of law") -- see article for his tripartite classification of rationality and types of cognition that "rational choice" rejects in its definition. He thinks Weber and Adam Smith got there before, and better than, Becker.

This book offers an original interpretation of the rise of sociology from a contemporary point of view that is both theoretically and historically informed. Rather than assuming the ‘dual revolution’ as watershed, it goes back behind the French Revolution and the industrial revolution in order to start from the more pervasive communication revolution. The central theme of the book is the currently topical one of the role played by discourse in the construction of knowledge. It is substantively developed through an investigation of a neglected period in the history of sociology. By closely analysing the contributions of such theorists as More, Hobbes, Vico, Montesquieu, Ferguson and Millar to the emergence of sociology in its original form, the argument follows the discursive construction of sociology in the context of the society-wide early modern practical discourse about violence and rights – what is here called the rights discourse. Parallels with the nineteenth- and twentieth-century discourse about poverty and justice and the contemporary discourse about risk and responsibility allow the author to reflect not only on the generation of knowledge through discourse, but also on the role that sociology itself plays in this process. The argument draws on the latest epistemological, theoretical and methodological advances. Constructivism is explored, Habermas and Foucault are creatively synthesised to arrive at a new formulation of the theory of discourse, and a finely elaborated frame and discourse analysis is applied – thus making a substantial contribution to the currently emerging cognitive sociology. Thanks largely to Piketty it's become increasingly clear that in the Reagan Revolution, middle class America sold its birthright for a mess of supply-side pottage. Dems willingness to credit GOP dogma -- raising taxes on high incomes and investment gains inhibits growth, deregulation spurs it -- are melting away. Post midterm losses, Dems are beginning to heighten rather than soft-pedal the policy contrasts between the parties. Wounded politically by perceptions that the ACA helps the poor at the expense of working people, they are looking for proposals attractive to the middle class. Emboldened by accelerating growth and employment gains, they are perhaps shedding inhibitions about leveling the playing field between workers and management. (..)To mess up my timeline a bit, Obama delivered a Pikettian narrative in Dec 2013 ..should have been a landmark speech on inequality (..) if he (and Dems) hadn't (tried to) protect their Senate majority. [In the Dec 2013 soeech] Obama zeroed in on policy choices. "As values of community broke down and competitive pressure increased, businesses lobbied Washington to weaken unions and the value of the minimum wage. As the trickle-down ideology became more prominent, taxes were slashes for the wealthiest while investments in things that make us all richer, like schools and infrastructure, were allowed to wither. And for a certain period of time we could ignore this weakening economic foundation (..) But when the music stopped and the crisis hit, millions of families were stripped of whatever cushion they had left. Jackson Jr. - Columbia Law School --- The SEC is currently considering a rulemaking petition requesting that the SEC develop rules requiring that public companies disclose their spending on politics. The petition, which was submitted by a committee of ten corporate law professors that we co-chaired, has received unprecedented support, including comment letters from nearly half a million individuals. (...)the petition has also attracted opponents, including prominent members of Congress and business organizations.This Article puts forward a comprehensive, empirically grounded case for the rulemaking advocated in the petition. We present (..) evidence indicating that a substantial amount of corporate spending on politics occurs under investors’ radar screens, and that shareholders have significant interest in receiving information about such spending. We argue that disclosure of corporate political spending is necessary to ensure that such spending is consistent with shareholder interests. We discuss the emergence of voluntary disclosure practices in this area and show why voluntary disclosure is not a substitute for SEC rules. We also provide a framework for the SEC’s design of these rules. Finally, we consider and respond to ten objections that have been raised to disclosure rules of this kind. The Power of Religion in the Public Sphere (Columbia University Press, 2011) represents a rare opportunity to experience a diverse group of preeminent philosophers confronting one pervasive contemporary concern: what role does—or should—religion play in our public lives? Reflecting on her recent work concerning state violence in Israel-Palestine, Judith Butler explores the potential of religious perspectives for renewing cultural and political criticism, while Jürgen Habermas, best known for his seminal conception of the public sphere, thinks through the ambiguous legacy of the concept of “the political” in contemporary theory. Charles Taylor argues for a radical redefinition of secularism, and Cornel West defends civil disobedience and emancipatory theology. Eduardo Mendieta and Jonathan VanAntwerpen detail the immense contribution of these philosophers to contemporary social and political theory, and an afterword by Craig Calhoun places these attempts to reconceive the significance of both religion and the secular in the context of contemporary national and international politics. Theory and Society - Special Issue: Current Routes to the Study of Contentious Politics and Social Change -- If social movements are an attempt by "outsiders" to gain leverage within politics, then one might expect the global spread of democracy to reduce social movement activity. This article argues the reverse. Granted, many past social movements, such as women's rights and civil rights, were efforts to empower the disenfranchised. However, this is not typical. Rather, social movements and protest tactics are more often part of a portfolio of efforts by politically active leaders and groups to influence politics. Indeed, as representative governance spreads, with the conviction by all parties that governments should respond to popular choice, then social movements and protest will also spread, as a normal element of democratic politics. Social movements should therefore not be seen as simply a matter of repressed forces fighting states; instead they need to be situated in a dynamic relational field in which the ongoing actions and interests of state actors, allied and counter-movement groups, and the public at large all influence social movement emergence, activity, and outcomes. -- downloaded pdf to Note

A broader study of petitioning is particularly warranted when the prevailing narratives—as of the years of the republic of 1649–609—concentrate on revolution, coercion, and exclusion and thus put a singular slant on the relations of rulers and ruled. (...) The sword certainly put the republic in place, but it neither wrote all its history nor dictated all its practices. In fact, familiar patterns and mechanisms of reciprocity counterpointed the disturbances of revolutionary change, held groups and individuals together, and constituted assets on which the republic could draw. (...) This article will take petitions and the responses they elicited as a measure of the openness, of the responsiveness, of the regime.... In its examination of petitioning—the process, problems of access, tactics, and language used—the article will work within certain narrow limits. Wartime exigencies had proliferated committees and commissions (accounts, army, excise, indemnity, navy, and plundered ministers...) to which countless parties petitioned, before which they pleaded, and from which they often appealed to higher authorities. This article confines itself for several reasons to solicitations of those higher authorities, (...) The descent of Leveller petitioners on parliament, whether in 1649–50, 1653–54, or 1659, certainly produced some revealing exchanges—on each side coercive intentions and language tended to run high—but what was revealed tends to reinforce the traditional picture of an embattled and exclusionary order.
