Anna Foy - Grainger and the ‘Sordid Master’: Plantocratic Alliance in The Sugar-Cane and Its Manuscript (2017) | The Review of English Studies | Oxford Academic
Scholarship on James Grainger’s perceived alliance with the West Indian plantocracy in The Sugar-Cane has so far not assimilated relevant information from the poem’s extant manuscript. In an unpublished comment on Adam Smith’s Theory of Moral Sentiments, Grainger rejects Smith’s characterization of planters as ‘sordid masters’ and plans his ‘vindication’ of planters accordingly. The published poem largely fulfils this plan: it argues that planters are not heritably incapable of moral sentiment, even as it accepts the Enlightenment’s institutional critique of slavery as a political system that cultivates bad moral habits in slave masters. Grainger relies on conjectural-historical reasoning then typical of Enlightenment moral philosophy, and he posits ‘probity’ as a bulwark against Creole degeneration. Manuscript evidence suggests further that Grainger sought probity in his own philosophical outlook. Although modern scholars have sometimes seen the poem as an attempt to win plantocratic favour, political references confirm that he took a position in the Canada-Guadeloupe controversy opposed to that of the powerful West India Interest. Moreover, during the course of composition, Grainger altered his portraits of planters to make them less flattering and more satirical—an editing process consistent with his apparent desire for philosophical impartiality. -- Downloaded via iPhone to Dbox

This essay engages critically with the recent emergence of "political realism" in political theory (centrally in the work of Raymond Geuss and Bernard Williams). While sympathetic to and convinced of the importance of the core of the enterprise which it identifies, the essay is critical of some of the claims made about the independence of politics from morality and the historically contingent character of political values, and suggests that realism may itself succumb to illusion. The final section sketches an account of the nature of evaluative judgment in the study of politics and, in conclusion, defends both the pluralist character of political theory and the pressing importance of the questions that realism raises and that are inadequately attended to by the bulk of post-war political theory.

This article examines the political (and Whig) agenda behind the earl of Shaftesbury's moral and religious thought, offering a reading of the so-called ‘moral sense’ that, based on Terry Eagleton's Marxist interpretation of moral-sense philosophy in general and Shaftesbury's use of the concept in particular, illuminates how far the moral sense serves a propagandistic purpose in Shaftesbury's writings. A close examination of this aspect, which has so far not been considered in the relevant literature on Shaftesbury, illuminates the anti-Hobbist and, by implication, anti-Tory (and High Church) tendency of his moral philosophy in the context of Low Church Anglicanism. -- Keywords: Shaftesbury; Thomas Hobbes; John Locke; Latitudinarianism; moral sense; Whiggism; Anglicanism

RJW Mills - Lord Kames's analysis of the natural origins of religion: the 'Essays on the Principles of Morality and Natural Religion' (1751) - (2016) - Historical Research - Wiley Online Library
This article investigates the discussion of the origins and development of religious belief within the Scottish jurist and philosopher Henry Home, Lord Kames's Essays on the Principles of Morality and Natural Religion (1751). Kames's work is argued to be a significant yet understudied contribution to the Scottish Enlightenment's examination of religion as a human phenomenon. The Principles contained one of the lengthiest analyses on the topic published by a Scottish literatus. In particular, Kames placed into a historical trajectory the internal sense theory's account of the non-rational origins of religious belief. In doing so, he provided an apologetic account of the progress from polytheism to monotheism resulting from the emergence of civil society, which set the tone for later Scottish discussions of religion.

Spinoza Research Network - Home
The Spinoza Research Network was set up in 2008 and funded by an AHRC Networks Grant between 2008 and 2010 at the University of Dundee. The funded project focused on contemporary interdisciplinary connections to seventeenth-century philosopher Baruch Spinoza and built up a membership of over 200 members in Philosophy, Politics, Law, Literature, Music, Psychology, History, Medicine, Gender Studies, Education, and many other academic and non-academic disciplines.

The grant has now expired, but the Network continues as an interdisciplinary group of academics, students, and others interested in Spinoza around the world. Working together, sharing research and developing new projects, we investigate how Spinoza is used both within philosophy and beyond it, both inside and outside of academia.

As of 2013 the Network is based at the University of Aberdeen.

Front matter including both overview TOC and very detailed TOC plus introductory chapter -- He explains in the intro how both Hume and Kant (via Rousseau) pursued "moral constructivist" approaches using a (modified) "natural law" framework - after Hume had successfully attacked weaknesses in traditional approach to natural law. Notes that "justice" traditionally one of the 2 branches of moral philosophy (the other ethics). He's especially concerned with failure of "business ethics " as cause of financial crisis and Great Recession - but "business ethics" meaningless without a framework of "Justice." His target audience includes lawyers and legal/jurisprudence students and scholars - he thinks legal positivism and legal realism has run out of steam. Whereas Seneca's critics argue that his life and alleged compliance with Nero contradicts his Stoic, noble-sounding principles, discrediting the latter; in his two late books on the Stoic, Diderot argues that Seneca's continual attempts to mollify Nero's tyranny betters the philosophy.  Where Diderot's critics reduce the two works on Seneca to veiled attacks on Rousseau, Diderot is critical of those texts wherein Seneca advocated the withdrawal & “leisure of the sage” or the vita contemplativa, while Rome burnt (“Rousseau est la figure moderne et honnie du détachement, qui permet à Diderot de dissocier Sénèque du détachement stoïcien. » (Lojskine 2009))  Whether contra Rousseau or no, Diderot is most attracted—amongst all Seneca's works Diderot examines—to Seneca’s On Benefits, and wants to restore compassion, even justified anger, to Stoicism.  Whether to justify himself for his own naivety in trying to teach Catherine of Russia or not, Diderot defends Seneca’s attempts to mollify Nero, led by De Clementia; he appeals, a la Shaftesbury and others, to Seneca’s “coeur” and compassion, beyond his Stoicism, notably in On Benefits; he criticises Stoic fatalism and appeals to a paraStoic notion of “natural rights” to justify resistance to tyranny; famously celebrating the American revolution as as lesson to all Europe.  So, beneath the "miserable" polemics (Cittion), there remains a good deal of philosophy; beneath the rhetorical smoke, (to use a Stoic-ism) a good deal of theoretical fire.  This paper aims at retrieving this fire, and situating Diderot's mitigated Stoicism as a French avatar of the moral sentimentalist position, with roots in the Stoic idea of oikeosis (and of parental love as the elementary cell of sociablity), as articulated by CIcero. Two guiding themes in our investigations and readings will be that theories of affect are (1.) a radicalization of modern moral sentimental theories of sociality (think David Hume on associationism, Adam Smith on sympathy, and Jane Austen on agreeableness); and (2.) a response to the hermeneutic turn in literary and political analysis. Thus, an important site of consideration will be the contributions that theories of affect make to issues of political equality, solidarity, mediation, and language.

The first half of the course is dedicated to selected writings of Gilles Deleuze and Gilbert Simondon, to Simondon’s influence on Deleuze’s account of assemblages (agencement), and to the latter’s unique articulation of a process theory of difference and repetition. The idea here is that Deleuze on repetition and Simondon on disparation offer the ontological grounds for affect theory.

The second half of the course is dedicated to the exploration of diverse writers in/around affect theory and their critics – all of whom, in direct or indirect ways, take up some of the ideas articulated and explored in the first half of the course. Important to this second half of the course will be the function of political and aesthetic judgment to affect theory.

Harro Höpfl presents here a full-length study of the single most influential organized group of scholars and pamphleteers in early modern Europe (1540–1630), namely the Jesuits. He explores the academic and political controversies in which they were engaged in and their contribution to academic discourse around ideas of 'the state' and 'politics'. He pays particular attention to their actual teaching concerning doctrines for whose menacing practical implications Jesuits generally were vilified: notably tyrannicide, the papal power to depose rulers, the legitimacy of 'Machiavellian' policies in dealing with heretics and the justifiability of breaking faith with heretics. Höpfl further explores the paradox of the Jesuits' political activities being at once the subject of conspiratorial fantasies but at the same time being widely acknowledged as among the foremost intellects of their time, with their thought freely cited and appropriated. Long framed by her critics as a pedantic précieuse, Scudéry has only recently attracted the interest of professional philosophers. Critics have dismissed her lengthy novels as unreadable, her famous Saturday salon as amateurish, and her philosophical ideas as derivative and confused. In the recent feminist expansion of the canon of humanities, however, another Scudéry has appeared. In this reevaluation, the philosophical significance of her writings has emerged. Her literary corpus presents a novel version of the ancient philosophical method of dialogue; it also expresses original, sophisticated theories concerning the ethical, aesthetic, and theological disputes of early modernity.

From: Journal of the History of Philosophy, Volume 44, Number 1, January 2006 pp. 47-63 | 10.1353/hph.2006.0004 *--* It is argued that Adam Smith criticizes David Hume's account of the origin of and continuing adherence to the rule of law for being not sufficiently Humean. ["Humean" is used for his tendency to use proto-evolutionary explanations of social phenomena in terms of psychological and material factors acting on individuals rather than rationalistic explanations] Hume explained that adherence to the rule of law originated in the self-interest to restrain self-interest. [Treatise 3.2.2,13-14, 316] [Smith says Hume's account is "too refined - TMS II, ii.3.5 ] According to Smith, Hume does not pay enough attention to the "unsocial" passion of resentment and the passion of admiration, which have their source in the imagination. Smith's offers a more naturalistic and evolutionary account [more Humean than Hume] of the psychological pre-conditions of the establishment and morality of justice. Yet, Smith's account also makes room for a thin conception of Lockean natural right to property, while rejecting the contractualist and rationalistic elements in Locke. It emerges that Smith severs the intimate connection that Hobbes and Hume made between justice and property. - paywall

À travers ses hiérarchies, ses valeurs et surtout les schèmes cognitifs et rhétoriques qui structurent le travail d’apprentissage, l’École tend à doter les agents d’une conception de la philosophie conforme à la formule scolaire mise au point il y a plus d’un siècle dans un contexte très singulier. Étant la « discipline du couronnement », située au-dessus des savoirs, des autres disciplines, la philosophie se veut discours sur les fondements.
Le cas de Sartre est d’un intérêt majeur en ce qu’il offre une illustration des tensions entre l’héritage scolaire et la quête d’originalité qui peut comporter, entre autres défis, celui d’avoir à se situer sur le terrain des sciences sociales. Si l’intérêt de Sartre pour ces disciplines était très réel, on peut comprendre certains aspects de son œuvre (autrui, la dialectique) comme un effort pour préserver les hiérarchies philosophiques

Abstract

A primary concern of Stanley Cavell’s Carus Lectures is to respond to the question posed in the first sentence of the Introduction: “Is Moral Perfectionism inherently elitist?” By elitist, he means undemocratic. While there are senses in which he would not want to deny that Moral Perfectionism is elitist, and while he admits that there are perfectionisms that do not require democracy, neither of these are Cavell’s concern. Rather, he wants to showcase his preferred version of perfectionism, variously named Moral, Emersonian and Nietzschean perfectionism.

Samuel Moyn review of Larry Siedentop's Invention of the Individual" - Did Christianity Create Liberalism? | Boston Review
Very interesting re the (19thC) "French" approach to liberalism -- historicist stressing process, contingency. Contrast with Anglo-Saxon social contract that takes the individual as its (unexamined) premiss, as does economic theory based on satisfying individual preferences etc. LS wrote an important article on the French approach. So Moyn sees LS as working to update and revise Guizot. Problem is LS (and all those claiming Christianity the basis of individual "natural rights") can't explain how the next world focus of Jesus and Paul became a this-world focus with the role of the individual as foundational. Moyn critiques the steps LS takes starting with the moral revolution of Augustine and working through the Middle Ages.

Eighteenth-Century Studies, Vol. 43, No. 1 (FALL 2009), pp. 37-54 -- Recent discussions of the automaton in eighteenth-century British culture have situated this figure in relation to shifting concepts of feminine identity. However, comparatively little attention has been spent on the automaton's relation to masculinity. In light of this, my essay considers parallels between automata and representations of men of feeling in the sentimental novels of Sterne, Smollett, and Mackenzie. Juxtaposing these novels with spectacles of automata like Cox's Museum reveal at least two interesting insights: (1) the man of feeling's automatically-reactive sensibility destabilizes eighteenth-century conceptual boundaries between humans and machines; and (2) in breaching these boundaries, men of feeling point to important shifts in the relationship between the mechanical and the virtuous as the century progresses. -- looks like a useful lit survey -- downloaded pdf to Note

History of Political Thought 28/1 (2007), 1-29 -- Modern accounts of Stoic politics have attributed to Zeno the ideal of an isolated community of sages and to later Stoics such as Seneca a cosmopolitan utopia transcending all traditional States. By returning to the Cynic background to both Zeno's Republic and the Cosmopolitan tradition, this paper argues that the distance between the two is not as great as is often supposed. Publication: Journal of the History of Philosophy, Oct 2014 In his De Constantia of 1584, Justus Lipsius examines the Stoic theory of fate, distancing himself from it by outlining four key points at which it should be modified. The modified theory is often presented as a distinctly Christianized form of Stoicism. Later, in his Physiologia Stoicorum of 1604, Lipsius revisits the Stoic theory, this time offering a more sympathetic reading, with the four modifications forgotten. It is widely assumed that Lipsius’s position shifted between these two works, perhaps due to a better grasp of the Stoic position by the time of the later work. Publication Name: Sophia (in press) -- This paper examines Shaftesbury’s reflections on the nature of philosophy in his Askêmata notebooks, which draw heavily on the Roman Stoics Epictetus and Marcus Aurelius. University of Chicago -' Nietzsche famously proclaimed the "death of God," but in so doing it was not God's death that was really notable -- Nietzsche assumes that most reflective, modern readers realize that "the belief in the Christian god has become unbelievable" (GS 343) -- but the implications of that belief becoming unbelievable, namely, "how much must collapse now that this faith has been undermined," in particular, "the whole of our European morality" (GS 343). What is the connection between the death of God and the death of morality? I argue that Nietzsche thinks the death of God will undermine two central aspects of our morality: its moral egalitarianism, and its belief in moral responsibility and warranted guilt. I review and evaluate the intellectual historian Christian Emden's recent book Nietzsche's Naturalism: Philosophy and the Life Sciences in the Nineteenth Century (Cambridge University Press, 2014). Is the mind distinct from the brain or are we just physical stuff? Are we autonomous agents or merely at the mercy of the causal and mechanistic laws of nature? When, if ever, is it acceptable to sacrifice one for the greater good of many? That these questions have remained at the heart of philosophy for so long, and that their ‘solutions’ (e.g., monism vs. dualism) seem to be incommensurable with each other, strikes us as enigmatic. Might the intractable nature of these and other appropriately identified problems reflect something peculiar about us rather than something peculiar about the way the world is? (...) Nietzsche scholarship has made impressive progress over the last thirty years, with lots of excellent work now available to help puzzled readers understand Nietzsche's provocative and often beautiful writing. Maudemarie Clark's Nietzsche on Truth and Philosophy was a big step forward in our understanding of his metaphysics and epistemology. Her Nietzsche on Ethics and Politics is a collection of fourteen essays mostly on Nietzsche's practical philosophy, ending with four on metaphysical issues that are related to the normative issues discussed earlier in the book. Most were published previously -- the oldest in 1987 and the newest in 2014 -- though two are revised versions of unpublished lectures and one is a remix of material from her recent book. Some appeared in obscure venues, so this volume helps readers access all of them. -- Highly recommends the introduction discussing each essay and broader framework for placing her discussion

What role should reason play in the creation of a free and just society? Can we claim to know anything in a field as complex as politics? And how can the cause of political rationalism be advanced when it is seen as having blood on its hands? These are the questions that occupied a group of British poets, philosophers, and polemicists in the years following the French Revolution. (..) argues that much literature of the period is a trial, or a critique, of reason in its political capacities and a test of the kinds of knowledge available to it. For Wordsworth, Coleridge, Shelley, Burke, Wollstonecraft, and Godwin, the historical sequence of revolution, counter-revolution, and terror in France—and radicalism and repression in Britain—occasioned a dramatic reassessment of how best to advance the project of enlightenment. The political thought of these figures must be understood, Michael contends, in the context of their philosophical thought. Major poems of the period, including The Prelude, The Excursion, and Prometheus Unbound, are in this reading an adjudication of competing political and epistemological claims. This book bridges for the first time two traditional pillars of Romantic studies: the period’s politics and its theories of the mind and knowledge. Combining literary and intellectual history, it provides an account of British Romanticism in which high rhetoric, political prose, poetry, and poetics converge in a discourse of enlightenment and emancipation.

Forum - Samuel Moyn's "Christian human rights" - overview page | The Immanent Frame
In 2010, Samuel Moyn published The Last Utopia: Human Rights in History, which offered an alternative historical explanation for the origins of human rights. He rejected narratives that viewed human rights as a long-term historical product of the Judeo-Christian tradition, The French Revolution, or Enlightenment rationalism, arguing that human rights as it is now understood began to emerge only during the 1970s. Prior to this, according to Moyn, rights were connected to the nation-state and had nothing to do with an international standard of morality or justice. In addressing critiques of The Last Utopia, Moyn has given considerable attention to the relationship between human rights and religion, conceding that there is, undoubtedly, a relationship between Christianity—Catholicism in particular—and human rights, but arguing that the “death of Christian Europe” by the 1960s “forced a complete reinvention of the meaning of human rights embedded in European identity both formally and really since the war”. Contributors offer their thoughts on Moyn’s article “Personalism, Community, and the Origins of Human Rights,” which became a central focus (see excerpt) in his forthcoming book, Christian Human Rights (University of Pennsylvania Press, 2015). Hopgood’s bracing critique of rights talk and his call for a less lofty, more pragmatic dispensation forces us to face the implications of the loss of theological anthropology for concepts of human equality and dignity. Can we have a rationally coherent, morally compelling, and historically sustainable discourse as well as a practice of humanistic values and human rights absent a “thick” metaphysical or religious framework, such as the one provided in the Western tradition for some two millennia by Judeo-Christian sources? Put another way, the question “Can we be good without God?” does not strike nearly deep enough. The urgent question is: Will we still be good to the stranger in our midst, or good in the same ways, once we have fully grasped the contestable character of humanism and once we have utterly abandoned the essentially religious idea that every person is made, in the enigmatic language of Scripture, in the image of God? A cri de coeur for putting legal theory and history back together with social theory and empirical social sciences,. -- In the early part of my career, legal history and the history of legal ideas were closed books to me, as I made my way in a field of criminal law scholarship dominated by doctrinal scholarship and by concept-focused philosophical analysis of the foundations of criminal law. These 2 very different paradigms have 1 big thing in common: They tend to proceed as if the main intellectual task is to unearth the deep logic of existing legal doctrines, not infrequently going so far as to read them back onto history, as if things could never have been other than they are. (..)I have increasingly found myself turning to historical resources (1) [to examine] the contingency of particular legal arrangements, and (2) ...to develop causal and other theses about the dynamics which shape them and hence about the role and quality of criminal law as a form of power in modern societies. So, in a sense, I have been using history in support of an analysis driven primarily by the social sciences. (..) it is no accident that all of the great social theorists, from Marx to Foucault via Weber, Durkheim, and Elias, ..have incorporated significant historical elements into their interpretations .... Lacey's article (..) criticizes the scholarship on criminal responsibility for being too concerned with “its conceptual contours and moral foundations,” “rather than with what it is for[:] its social roles, meaning, and functions.” Here is what she is arguing against. There are theorists, myself included, who think of questions of responsibility in philosophical terms. These moral truths are not socially or historically contingent; they are constant questions to which we seek answers. (..) In some ways, this is a (boring) methodological debate. What I care about as responsibility is not what she cares about as responsibility. -- YIKES -- Apart from the travesty of equating legal norms with "moral truths," this looks like moral realism run amok -- the questions may be "constant" but who gets to frame the Qs, what values are doing the framing (blood money, retribution, restitution, prevention, hierarchy reinforcement, group purification), what anthropology and epistemology implicitly govern the framing (universal depravity, trial by ordeal, women's testimony is unreliable?), the defined criteria (lower orders don't have honor they can defend, husbands can't commit rape), how criteria are to be applied, by whom (civil vs religious authority, manor courts vs king's law, lie detector operators, NSA algorithms?) -- "Philosophical" inquiry is limited to *a priori* concerns, and "philosophical" answers are limited to eternal Platonic "moral truths". But if normative Qs & As are by definition not contingent on changing institutions and social assumptions re behavior, what's's the foundation for her inquiry process? Armchair "fine-grained" intuitions re "mental states"? So do we get new "moral truths" along with the each new neuroscience study? "Proof there's no free will!"="moral truth" (let everybody out of jail?) and next month "Latest study finds the free will spot"=oops, new eternal "moral truth" (can we test it like DNA?) -- Analytic philosophy rediscovering Aristotelian categories is bad enough, but analytic neo-Platonic anthropology gets me actively hostile, and it's even more absurd if we're talking about criminal law -- didn't download

Renaissance jurisprudence strove to be a sociable science. Following Ulpian’s lead, it refused to relegate jurisprudence either to pure speculation or to mere practice. Jurisprudence was a science, a matter of knowledge and of theoretical understanding, not merely an applied art or practice of prudence innocent of theory. It was regarded as the very heart of theoretical studies, drawing to itself all that the traditional sciences of theology, metaphysics, and moral philosophy, as well as the newly emerging humanist sciences of philology and hermeneutics, had to offer. No less resolutely, however, it refused to abandon its foothold in the life of practice. (..) Rather than reject philosophical reflection, (..) Renaissance jurists sought to locate it in concrete human life and experience. (..) Philosophy.., was most true to its vocation, and was most engaged in human life, when its reflections were anchored in the social life acknowledged, comprehended, and informed by and informing law. Jurisprudence, vera philosophia, was ...the point at which the theoretical and the practical intersected (..) at its “sociable” best sought to integrate them. Whereas legal philosophers offer “analyses” that aim to be general, abstract, and timeless, legal historians offer “thick descriptions” of what is particular, concrete, and time-bound. But surface appearances can deceive. Perhaps unlike other areas of philosophy, the subject matter of jurisprudence is at least partially (if not entirely) a social phenomenon. Courts, legislatures, judicial orders, and statutes are the products of human efforts, both collective and individual, and they only exist as legislatures, courts, and the like insofar as they possess the meaning they do in the eyes of at least some social group. For this reason, legal philosophers since at least H.L.A. Hart have recognized their task to be a “hermeneutic” one—one which aims to discern or make explicit the “self-understanding” of legal actors. At the same time, legal historians aim not simply to record legal rules that existed at some given point in history, but to unearth the meaning that actual people—judges, lawyers, politicians, and ordinary citizens—have attached to law. When they do so, they might be seen as uncovering evidence of those same “self-understandings” that philosophers claim constitute law. NYU School of Law, Public Law Research Paper No. 08-35 -- General jurisprudence purports to consider law in general. But to break out of the arid abstractions of analytic legal philosophy, it may be worth also giving some jurisprudential consideration to the distinctive features of law in the context of a particular kind of political system. This paper considers the jurisprudence of law in a modern democracy. It explores a suggestion (made by Ronald Dworkin and others) that legal positivism might be a theory particularly apt for a democracy. And it explores the meaning and significance for democratic political theory of ideas like the generality of law, the separation of law and morality, the sources thesis, and law's public orientation.
