Alexander Hamilton was the first U.S. Treasury Secretary from 1789 to 1795. When he started, the Federal Government was in default. During his tenure, U.S. Treasuries became the ultimate safe asset. He successfully managed expectations, achieved debt service reduction, and stabilized financial panics. He delivered sound public finances and financial stability. In the end, the U.S. possessed a modern financial system able to finance innovation and growth. At a time when Europe is working its way out of the sovereign debt crisis and implementing Banking Union and Financial Union, it is worthwhile to search for lessons from early U.S. history. - downloaded via iPhone to DBOX

(..) The thesis of this article is that corporate officers are fiduciaries because they are agents. (..) drawing on the fiduciary duties of agents for guidance in fashioning modern understandings of corporate officer duties - and differentiating those duties from those of directors - can provide much-needed structure to what otherwise threatens to be an ad hoc enterprise. There are at least 3 benefits of our thesis. (1) state law remains the primary source for establishing the basic framework of corporate governance relations, both through corporate statutes and through judge-made fiduciary duty law. (..) (2) our thesis clarifies immensely why courts can and should more closely scrutinize officer conduct than they now review director performance (..). (3) At a theoretical level, ...our thesis has several implications. (..) we are entering an era when, due to heavier corporate regulation, the entity conception of the firm will be strengthened, as positive law, including agency law, still builds on that understanding of corporate relations. This period follows a span of perhaps 20 years when a highly disaggregated conception of corporate relations - the nexus of contracts theory - has predominated. Georgetown University Law Center -- The main purpose of this Article is to begin to recover and elucidate the core textual basis of a progressive approach to constitutional law, which appears to have been embraced in essential respects by many influential figures, including Wilson, Hamilton, Marshall, and the two Roosevelts, and which rests on an implied power to promote the general welfare. To pursue this objective, the Article relies on two strange bedfellows: the law of corporations and the philosopher Paul Grice. An ordinary language philosopher like Grice, (..) might seem like an unlikely ally to enlist in this endeavor. (..) underestimating the significance of Grice’s ideas for constitutional law would be a mistake. Plausibly interpreted, the Constitution vests an implied power in the Government of the United States to promote the general welfare, and Grice’s distinction between semantic and pragmatic implication is a helpful means of understanding why. After a general introduction, the Article first summarizes some key aspects of Grice’s philosophy of language and then briefly illustrates their relevance for constitutional law. Consider the following passages from the anguished dissents (..by) Scalia and Alito in Obergefell: [re their "indifference" re substance of SSM - notes how much this clashes with their Catholic beliefs that insist on moral absolutes determined by "natural law"] -- Federalism is (..) as a practical matter, as a means of acknowledging the diverse views we have about matters of political or social morality (..) there's much to said for this as a means for maintaining social peace, albeit at the cost of accepting the maintenance of what many might consider significant injustice in some of the states. But note well that what Scalia and Alito are doing is really reviving the theory of "popular sovereignty" best identified with the Little Giant Sen. Stephen A. Douglas with regard to the issue of slavery. (,.) Douglas professed himself indifferent to the moral critique of slavery. (..) What this translated into was the desirability of letting each state, as it joined the Union, make its own decision as to slavery or freedom. Somewhat more complicated was the right of the pre-state territory to make its own decision, in territorial legislatures, to welcome slaveowners. Douglas, to his political detriment, argued that they could place stumbling blocks in the way of the slaveowners, but, if they chose not to, that was all right too. The important thing was to recognize the fundamentally "federal" nature of the Union, a collection of people with decidedly different views about the legitimacy of owning other human beings as chattels, and to allow that decision to be made locally rather than on a one-size-fits-all national basis.

Yes, Free Community College Is Major, But Not Just For The Reason You Think | TPM Jan 2015
by Ed adviser at New America Fiundation - explains that it's the 1st step of brunging some order & accountability to state policies re their investment in their universities and community colleges - the federal student loans has been a sort of blank check for states to pass rising costs onto the gederal givernment and to students via tuitions and huge losns with no discipline or accountability - the Obsma ain proposal is less about the $s the states would have to contribute (California pribably alteady meets the 25% threshold for funding its community colleges frex) than requiring states to make a commitment for both good and bad times. Rught now they can go hog wild expanding campuses, faculties, etc when their dconomy is booming and push the ongoing costs of those decisions onto students and the federal gov when the economy is poor. And they haven't been passing the good times along to students as reduced tuition (and federal loans) during good times, so costs have increased at far faster than inflation for decades.

With the planet warming and extreme weather becoming the new normal, states and communities are seeking out resources to help them anticipate climate impacts and protect residents, homes, businesses, and public infrastructure from rising seas, heat, drought, wildfires, extreme weather, and other climate impacts. The Georgetown Climate Center strives to help communities meet these challenges by addressing the legal barriers that communities face when adapting to rising sea levels, and seeks to help localities prepare for the increased frequency, scope, and severity of heat events and extreme weather. The Center also strives to help communities spend disaster relief funds wisely by preparing for the next big storm – not just rebuilding to meet the status quo. The Georgetown Climate Center provides its clients with broad legal advice and policy options, along with strategies to adapt to each set of challenges. It also provides technical assistance to selected states and localities.

Preparing Our Communities for Climate Impacts: Recommendations for Federal Action | Georgetown Climate Center - September 2014
The Georgetown Climate Center released 100 recommendations today to improve federal programs that could be used to prepare for climate change. The new report will inform the White House State, Local and Tribal Leaders Task Force on Climate Preparedness and Resilience.The report draws from a series of workshops with leading federal, state and local officials and builds upon lessons learned post-disaster in New Orleans (following Hurricane Katrina), New York (Hurricane Sandy) and Vermont (Hurricane Irene). The report identifies more than 30 federal programs, initiatives and laws that can be used to prepare for extreme events such as storms, floods and heat waves as well as rising seas. Although state and local governments will be the primary actors when it comes to preparing for climate change impacts, the federal government can boost – or impede – preparedness. The federal government sends billions of dollars to states and communities every year, some of which could be used more effectively to adapt to climate change. Federal laws and regulations also can be important drivers of state and local action. But, in some cases, federal rules have hindered state and local innovation. The recommendations in the report explore how existing federal dollars, programs, regulations and policies can be retooled, repurposed and deployed to promote and remove barriers to adaptation. -- downloaded pdf to Note

NYU School of Law, Public Law Research Paper No. 12-26 -- "Inaugural Lecture" for the Chichele Professorship of Social and Political Theory. -- Political theorists study (1) political virtue, (2) political processes and institutions, and (3) political ideals (like justice, liberty, and equality). Since the time of Hume, Madison, and Kant, it has been thought that (2) is more important than (1), because maybe we can set up institutions that work for the general good whatever the state of virtue of the people... But in the revival of political philosophy heralded by Rawls in 1971, there has been great emphasis on (3) and not nearly enough on (2)... particularly in the UK. Chichele chair -holders G.A. Cohen and Isaiah Berlin focused almost exclusively on (3) -- with Berlin announcing that political philosophy was really just the study of "the ends of life." -- I argue for a reorientation of political theory teaching and scholarship back towards institutions -- particularly the normative evaluation of the political process and the exploration of institutional principles like democracy, representation, bicameralism, the rule of law, the separation of powers, federalism and so on. ..these issues should not be left to empirical or comparative politcial science, because they raise important and complex questions of evaluation that may be sold short by the pragmatic and consequentialist emphasis of empirical and comparative work. But political theory should respect the empirical study of institutions more than it does, and it should dovetail the normative and evaluative work that political theory involves with the understanding of institutions, processes, and practices that political science generates. -- downloaded pdf to Note

Text & video - Introduction to the concepts in his new book -- What I'd like to do today is present two ideas about morality on two different levels. One is: What is the structure of moral problems? Are there different kinds of moral problems? And the other is: What is the structure of moral thinking? Are there different kinds of moral thinking? And then put those together to get at a kind of normative idea, which is that the key to moral progress is to match the right kind of thinking with the right kind of problem.

Morality is fundamentally about the problem of cooperation....... There are different ways for groups to be cooperative, and they can work fine separately, but what happens when you have different groups that come together? First, there are really two different kinds of cooperation problems. One is getting individuals within a group to cooperate, and the other is getting groups that are separately cooperative to cooperate with each other. One is the basic moral problem, and that's the problem that our brains were designed to solve. Then you have this more complex modern problem,,...... At least for some people a lot of the time, the first thought is to be cooperative. That suggests that we do, indeed, have these claims of instincts, whether they're genetic instincts, or culturally honed instincts, or instincts honed from one's personal experience, whatever it is, the point-and-shoot automatic settings say, "Go ahead and do the cooperative thing." It's manual mode thinking that says, "Wait a second, hold on, I could really get screwed here. Maybe I shouldn't do this."

JSTOR: Publius, Vol. 37, No. 4 (Fall, 2007), pp. 551-577 -- downloaded pdf to Note -- The common perception that Montesquieu is not a major theorist of federalism is due both to the peripheral nature of his account of confederate republics and his praise of the unitary British Constitution in the "Spirit of the Laws." This study challenges this view by arguing that, despite his endorsement of the separation of powers, Montesquieu had serious reservations about England's highly centralized system of parliamentary sovereignty. Moreover, his most significant reflections on federalism were not contained in his brief treatment of confederate republics, but rather in his lengthy consideration of Gothic constitutionalism. I conclude that Montesquieu's complex constitutional theory involves two distinct dimensions including both the separation of powers exemplified in England and the federal principles in the decentralized Gothic system of medieval France.

Consulting Montesquieu’s teaching on Greek foreign policy, both republican and imperial, elucidates the character of these peaceful mores. Montesquieu weaves a modernization tale from primitive ancient Greece to modern commercial states, all to teach the reader to overcome any lingering attachment to glory and to adopt the rational standards of national interest and self-preservation. This account provides important insights on the relationship between realism and idealism in Montesquieu’s international relations teaching and helps scholars to rethink how these categories are construed.
