Friedrich Albert Lange (b. 1828, d. 1875) was a German philosopher, pedagogue, political activist, and journalist. He was one of the originators of neo-Kantianism and an important figure in the founding of the Marburg school of neo-Kantianism. He also played a significant role in the German labour movement and in the development of social democratic thought. A cri de coeur for putting legal theory and history back together with social theory and empirical social sciences,. -- In the early part of my career, legal history and the history of legal ideas were closed books to me, as I made my way in a field of criminal law scholarship dominated by doctrinal scholarship and by concept-focused philosophical analysis of the foundations of criminal law. These 2 very different paradigms have 1 big thing in common: They tend to proceed as if the main intellectual task is to unearth the deep logic of existing legal doctrines, not infrequently going so far as to read them back onto history, as if things could never have been other than they are. (..)I have increasingly found myself turning to historical resources (1) [to examine] the contingency of particular legal arrangements, and (2) ...to develop causal and other theses about the dynamics which shape them and hence about the role and quality of criminal law as a form of power in modern societies. So, in a sense, I have been using history in support of an analysis driven primarily by the social sciences. (..) it is no accident that all of the great social theorists, from Marx to Foucault via Weber, Durkheim, and Elias, ..have incorporated significant historical elements into their interpretations .... Jack Balkin - Obergefell and Tradition | Balkinization - June 2015
It is tempting to identify the dissenters with Burke, and view Kennedy as opposed to Burkeanism. Certainly the dissenters would like to brand Kennedy as a revolutionary or Jacobin, heedlessly destroying a valued institution at the center of society. But this is a caricature of what Kennedy is actually doing in his opinion. Kennedy's use of tradition is also Burkean in its own way. He simply emphasizes different features of Burke's thought. In particular Kennedy emphasizes change through respect for tradition that results from discussion and lived experience--as opposed to change that occurs through violence and revolutionary upheaval. Kennedy emphasizes the natural evolution and growth of previous commitments through debate, contestation and social practice. Our commitments evolve as they we apply them to changed factual circumstances and our wisdom grows through encountering those changed circumstances in practical terms. We can have greater confidence in our judgments achieved in this way because, unlike previous generations, we have the benefit of their experience, while they do not have the benefit of ours.

Reviewed by Vanessa Carbonell, University of Cincinnati -- (..) she seeks to show that those impossible actions really were required and that you really did fail -- not in the sense of being to blame, but at least in the sense of having done wrong. (..) she looks to recent work in empirical moral psychology to support her vindicating story. Rather than dismiss people's experience of moral failure as irrational or misguided, Tessman claims that our intuitive moral judgments are largely arational. This chapter contains an overview of the "dual process" model of moral judgment and meticulously annotated discussions of the work of Daniel Kahneman, Joshua Greene, Jonathan Haidt, Jesse Prinz, Tamar Gendler, Philip Tetlock, and many others. Readers unfamiliar with this literature will find it a helpful introduction; readers familiar with and interested in these debates will probably find it overly ambitious. Suppose that we accepted every piece of Tessman's carefully assembled empirical story: that the dual process and social intuitionist models are roughly correct; that experiences of impossible demands are a moral case of Gendler's "alief"; that they involve Greene's "alarm bell" emotions; that moral judgments are what Prinz calls "prescriptive sentiments" or "oughtitudes"; that non-negotiable requirements trade on what Tetlock and colleagues call "sacred values"; etc. (..) It felt in the end like we simply had a lot more cool vocabulary for describing the purported data -- that people have experiences of impossible requirements and moral failure -- but no more reason to think that these experiences ought to be trusted as guides to what the demands of morality really are. -- interesting re overview of work in empirical moral psychology

This book offers an original interpretation of the rise of sociology from a contemporary point of view that is both theoretically and historically informed. Rather than assuming the ‘dual revolution’ as watershed, it goes back behind the French Revolution and the industrial revolution in order to start from the more pervasive communication revolution. The central theme of the book is the currently topical one of the role played by discourse in the construction of knowledge. It is substantively developed through an investigation of a neglected period in the history of sociology. By closely analysing the contributions of such theorists as More, Hobbes, Vico, Montesquieu, Ferguson and Millar to the emergence of sociology in its original form, the argument follows the discursive construction of sociology in the context of the society-wide early modern practical discourse about violence and rights – what is here called the rights discourse. Parallels with the nineteenth- and twentieth-century discourse about poverty and justice and the contemporary discourse about risk and responsibility allow the author to reflect not only on the generation of knowledge through discourse, but also on the role that sociology itself plays in this process. The argument draws on the latest epistemological, theoretical and methodological advances. Constructivism is explored, Habermas and Foucault are creatively synthesised to arrive at a new formulation of the theory of discourse, and a finely elaborated frame and discourse analysis is applied – thus making a substantial contribution to the currently emerging cognitive sociology. The contemporary relevance of the analysis lies in its linking of early sociology’s critique of modern society to the need under current conditions of an open history, contingency and uncertainty for cultivating a culture of contradictions and a participatory politics of conflict, contestation and compromise. -- downloaded pdf to Note

Since the 1970s, studies of risk have grown into a major interdisciplinary field of research. Although relatively few philosophers have focused their work on risk, there are important connections between risk studies and several philosophical subdisciplines. After providing a hermeneutical phenomenology of legal practice that locates legal interpretation at the center of the rule of law, the chapter considers three important hermeneutical themes: (1) the critical distinction between a legal historian writing aboout a law in the past and a judge deciding a case according to the law; (2) the reinvigoration of the natural law tradition against the reductive characteristics of legal positivism by construing human nature as hermeneutical; and. Two familiar features of Dworkin's theory of adjudication generate a strange predicament. Dworkin maintains that most cases, including most "hard" cases, have "right answers." Yet he also argues that to discover that right answer, judges must avail themselves of moral considerations and moral argument: a party's rights follow from the principle which explains some significant portion of the prior institutional history and provides the best justification for that institutional history as a matter of political morality. Yet if morality is, as many seem to think, "subjective" in some sense, then there may be as many right answers as a matter of morality as there are judges and thus, consequently, no single right answer as a matter of law. Dworkin's response asks us to distinguish between sensible, but defeasible, "internal" attacks on the objectivity of morality, from unintelligible, and irrelevant, "external" attacks on the objectivity of morality. Dworkin's internal/external distinction may be usefully recast as two competing paradigms of objectivity. ... by the "Naturalistic Conception," objectivity in any domain must be understood on the model of the natural sciences, whose objects of study are objective in the sense of being "mind-independent" and causally efficacious. The "Non-Naturalistic Conception," by contrast, denies that the type of objectivity found in the natural sciences is the relevant type of objectivity to aspire to in all domains. Dworkin's version of Non-Naturalism bears a striking similarity to John McDowell's. I conclude that neither version provides an adequate account of objectivity: they fail to explain basic intuitions about objectivity (even in ethics), as well as leaving us with a picture of the "objectivity" of ethics that would, in fact, be quite congenial to the non-cognitivism that both McDowell and Dworkin purport to have left behind. -- Number of Pages in PDF File: 42

U of Chicago, Public Law Working Paper No. 275 -- Should we think of what I will refer to generically as “the law of religious liberty” as grounded in the moral attitude of respect for religion or in the moral attitude of tolerance of religion? I start with a well-known treatment of the idea of “respect” by the moral philosopher Stephen Darwall. Re toleration, I shall draw on my own earlier discussion, though now emphasizing the features of toleration that set it apart from one kind of respect. In deciding whether “respect” or “toleration” can plausibly serve as the moral foundation for the law of religious liberty we will need to say something about the nature of religion. I shall propose a fairly precise analysis of what makes a belief and a concomitant set of practices “religious” (again drawing on earlier work). That will then bring us to the central question: should our laws reflect “respect” for religion” or only “toleration”? Martha Nussbaum has recently argued for “respect” as the moral foundation of religious liberty, though, as I will suggest, her account is ambiguous between the two senses of respect that emerge from Darwall’s work. In particular, I shall claim that in one “thin” sense of respect, it is compatible with nothing more than toleration of religion; and that in a “thicker” sense (which Nussbaum appears to want to invoke), it could not form the moral basis of a legal regime since religion is not the kind of belief system that could warrant that attitude. Legal philosophers have been preoccupied with specifying the differences between two systems of normative guidance - law and morality. Positivists such as Kelsen, Hart, and Raz propose a solution to this “Demarcation Problem” according to which the legal validity of a norm can not depend on its being morally valid, either in all or at least some possible legal systems. The proposed analysis purports to specify the essential and necessary features of law.... Yet the concept of law is an “artifact concept,” that is, a concept that picks out a phenomenon that owes its existence to human activities. Artifact concepts, even simple ones like “chair,” are notoriously resistant to analyses in terms of their essential attributes, precisely because they are hostage to human ends and purposes, and also can not be individuated by their natural properties. 20th-century philosophy of science dealt with a kindred Demarcation Problem: ...how to demarcate science from pseudo-science or nonsense. -- they sought to identify the essential properties of a human artifact (namely, science). U of Texas Law, Public Law Research Paper No. 128 -- This is an invited commentary on Richard Rorty's Dewey Lecture, given last year at the University of Chicago Law School. "Pragmatism," says Rorty, "puts natural science on all fours with politics and art. It is one more source of suggestions about what to do with our lives." I argue that the truth in pragmatism - that the epistemic norms that help us cope are the ones on which we rely - is obscured by Rorty's promiscuous version of the doctrine, which confuses the criteria for relying on particular epistemic norms (namely, that they work for human purposes) with the content of the norms themselves (most of which make no reference to human purposes, but rather criteria like causal or explanatory power). U of Chicago, Public Law Working Paper No. 257 -- This essay offers a new interpretation of Nietzsche's argument for moral skepticism.., an argument that should be of independent philosophical interest as well. On this account, Nietzsche offers a version of the argument from moral disagreement, but, unlike familiar varieties, it does not purport to exploit anthropological reports about the moral views of exotic cultures, or even garden-variety conflicting moral intuitions about concrete cases. Nietzsche, instead, calls attention to the single most important and embarrassing fact about the history of moral theorizing by philosophers over two millennia: namely, that no rational consensus has been secured on any substantive, foundational proposition about morality. Persistent and apparently intractable disagreement on foundational questions, of course, distinguishes moral theory from inquiry in the sciences and mathematics (perhaps in kind, certainly in degree). According to Nietzsche, the best explanation for this disagreement is that, even though moral skepticism is true, philosophers can still construct valid dialectical justifications for moral propositions because the premises of different justifications will answer to the psychological needs of at least some philosophers and thus be deemed true by some of them. The essay concludes by considering various attempts to defuse this abductive argument for skepticism based on moral disagreement and by addressing the question whether the argument "proves too much," that is, whether it might entail an implausible skepticism about a wide range of topics about which there is philosophical disagreement. -- Keywords: Nietzsche, morality, skepticism, metaethics, anti-realism -- downloaded pdf to Note

Moral disagreement is widely held to pose a threat for metaethical realism and objectivity. In this paper I attempt to understand how it is that moral disagreement is supposed to present a problem for metaethical realism. I do this by going through several distinct (though often related) arguments from disagreement, carefully distinguishing between them, and critically evaluating their merits. My conclusions are rather skeptical: Some of the arguments I discuss fail rather clearly. Others supply with a challenge to realism, but not one we have any reason to believe realism cannot address successfully. Others beg the question against the moral realist, and yet others raise serious objections to realism, but ones that—when carefully stated—can be seen not to be essentially related to moral disagreement. I would have those who deny moral significance to the historical method show how we may guide and control the formation of our further moral judgments if we forego inquiry into the process of their formation as historically set before us....... The point of the genetic method is then that it shows relationships, and thereby at once guarantees and defines meaning. We must take the history of any intuition or attitude of moral consciousness in both directions: both ex parte ante and ex parte post. We must consider it with reference to the antecedents which evoked it, and with reference to its later career and fate. It arises in a certain context, and as a reaction to certain circumstances ; it has a subsequent history which can be traced. It maintains and reinforces certain conditions, and modifies others. It becomes a stimulus which provokes new modes of action. Now when we see how and why the belief came about, and also know what else came about because of it, we have a hold upon the worth of the belief which is entirely wanting when we set it up as an isolated intuition. Pure intuitionalism. is often indeed undistinguishable from the crassest empiricism. The ' intuition' is declared to be a content of 'reason,' but reason is a mere label. The ordinary relation and criteria of rationality are expressly eliminated. Quite likely we have deified the results of a merely accidental history or series of circumstances. The only way to introduce reasonableness is to analyze in detail the course of events from which the intuition results, and to trace in further detail the influences that radiate from it. There is much ground for John Stuart Mill's basis of opposition to intuitionalism -- it tends to perpetuate prejudice and sanctify conservatism by calling them eternal truths of reason, and thus to erect barriers in the way of moral progress.
