Elonis is arguing for a subjective intent requirement, claiming that his posts were meant as rap lyrics and not as threats, while the prosecutors are arguing for an "objective" standard—a threat counts as a threat if a "reasonable person" would think the statement is a threat. The government is arguing that it’s enough to use an objective standard, with an exception for "idle or careless talk, exaggeration, something said in a joking manner or an outburst of transitory anger." However, when it comes to the Internet, where context or tone may be more difficult to perceive, this objective standard has obvious drawbacks [...] [UK has] law that forbids electronic messages that are "grossly offensive or of an indecent, obscene, or menacing character," [...] "with the intent to intimidate." Only DAU thinks Secret or Whisper or any other consumer grade app, on a consumer grade tablet or phone, promising keeping them anonymity, uses these apps to 'blow the whistle.' ahhm troll, hate and gossip or even leak stuff. I thought Silicon Valley ppl are smart. No they just know how to code & design ... "to make the world better" ... sort of. “A court order without probable cause or even a subpoena may be enough for law enforcement or for a civil litigant to demand records.“ Conley went on to say that anonymous app companies need to make sure their backend data practices line up with the advertised purpose of their product: “They need to think through their own process. If you are offering a service that is about providing anonymous communication, then if you are retaining their identity and tying it to their communication, then you are kind of undermining the whole purpose of your service.”

While the fights for rights of gay people and women are being fought in the newspaper columns, on our television screens and in the Houses of Parliament, with the baton taken up by politicians and celebrities alike, the demonising of transgender people continues in private among sniggering smartphone users and ignorant fools. Unchallenged, and largely unfashionable.

And ideally, they said, your network will contain fewer trolls since it’s composed mostly of your friends and your friends’ friends.
