Redaction error reveals FBI did target Lavabit to spy on Edward Snowden
A redaction oversight by the US government has finally confirmed that the Federal Bureau of Investigation’s targeting of secure email service Lavabit was used specifically to spy on Edward Snowden.

Ladar Levison, creator of the email service, which was founded on a basis of private communications secured by encryption and had 410,000 users, was served a sealed order in 2013 forcing him to aid the FBI in its surveillance of Snowden.

Levison was ordered to install a surveillance package on his company’s servers and later to turn over Lavabit’s encryption keys so that it would give the FBI the ability to read the most secure messages that the company offered. He was also ordered not to disclose the fact to third-parties.

Investigatory Powers Bill: May defends surveillance powers - BBC News
Mrs May has said Britain's spies must continue to be allowed to hack into foreign computer networks, under so-called "bulk equipment interference warrants", as this was "a key operational requirement for GCHQ".
She told MPs that bulk powers had played a significant role in every major counter-terrorism investigation over the past decade, including seven terror plots foiled in the past 18 months, and in responding to the bulk of cyber attacks against UK interests.

Security Experts Warn of Orwellian Future in Apple Case | Re/code
[ all without a warrant ] Your Samsung smart TV or Amazon Echo might spy on you next if the government succeeds in forcing Apple to disable security protections on a smartphone to further the FBI’s investigation into the San Bernardino attacks. Security experts from Stanford, Harvard and Rice universities and independent researchers laid out this Orwellian scenario in a court filing today, supporting Apple’s fight against a court order to help investigators hack a smartphone used by one of the assailants in the mass killing. Draft snooper's charter 'fails on spying powers and privacy protections' | World news | The Guardian
Theresa May’s draft “snooper’s charter” bill fails to cover all the intrusive spying powers of the security agencies and lacks clarity in its privacy protections, a parliamentary committee has said. The intelligence and security committee said the draft legislation published by the home secretary suffered from a lack of sufficient time and preparation. It was evident that even those working on the legislation had not always been clear about what it was intended to achieve, it said.

Jeremy Corbyn: Labour will campaign for UK to stay in the EU | Politics | The Guardian
McFadden stressed he did not believe Cameron was seeking to undermine those rights in his talks with his EU partners, but recognises that Corbyn is deeply concerned at what he regards is a shift from a social Europe to a free-market Europe. He said: “If the prime minister tries to water down hard won employment protections that would be wrong and foolhardy on his part and we would very strongly oppose it. But if he does try to water down these protections, the right response is not to leave the EU but to fight the 2020 election on a clear commitment to restore those employment rights – and we have to remain in the EU to do that.”

Russia will fork Sailfish OS to shut out pesky Western spooks
Paranoia over NSA tampering spurs de-Westernisation drive // well only the Paranoid survive. [...] Russia’s Minister of Communications and Mass Media, Nikolai Nikiforov, has taken part in talks to form a consortium that will aid Russia in developing a custom mobile OS, reportedly a forked version of Jolla’s Sailfish OS, to lessen its dependence on Western technology. Nikiforov held a working meeting last week with the leadership of Hong Kong-based Sailfish Holdings, developer of the quietly admired Sailfish OS. Alongside other participants, the parties involved discussed the use of open-source software in the public and private sectors, taking into account technical, economic and political factors, the latter of which is expected to include United States’ interference with exported technologies.

Pressure mounts over claims Police Scotland breached rules over spying on journalists (From Herald Scotland)
PRESSURE is mounting on ministers to take action on Police Scotland amid further criticism of the force over claims it illegally spied on a journalist to uncover sources. The force's elite Counter Corruption Unit (CCU) is said to have snooped on the reporter without getting judicial approval - a tactic which was banned on March 25 following a row over officers using the Regulation of Investigatory Powers Act (Ripa) to access journalists’ phone records, texts and emails. // [ endemic and systemic! you are not safe. period. ] // &! bbc.in/1OQEaGJ - Ministers questioned over Police Scotland 'spying' claims // &! bbc.in/1KUFPu9 &! bbc.in/1Maojno << time to get their story right!?

US torture doctors could face charges after report alleges post-9/11 'collusion' | Law | The Guardian
The largest association of psychologists in the United States is on the brink of a crisis, the Guardian has learned, after an independent review revealed that medical professionals lied and covered up their extensive involvement in post-9/11 torture. The revelation, puncturing years of denials, creates the potential for leadership firings, loss of licenses and even prosecutions. For more than a decade, the American Psychological Association (APA) has maintained that a strict code of ethics prohibits its more than 130,000 members to aid in the torture of detainees while simultaneously permitting involvement in military and intelligence interrogations.

A defense of Dave Morin | PandoDaily
[1bn consumer apps are more rare than lottery winners. period.] But despite it all, he just didn’t win. It’s crushing evidence of just how hard it is to build the next huge consumer Internet sensation. Mock Morin all you want, but pre-launch Google valued Path higher than it likely is valued today. If he was wrong to believe he could build the mobile Facebook, so were some of the smartest people in the Valley. So what did Morin do so wrong? Some parts of his thesis were right, but exact manifestations of that thesis weren’t. People were longing for a mobile social network focused on photos. People were longing for a Facebook-other. Just not the one he created. You can never predict how products will resonate. Did he focus too much on pleasing Valley early adopters while Snapchat and Whisper were resonating with teens, and Whatsapp largely got its legs through an international audience? Perhaps. Law changed to allow GCHQ hacking ... just as GCHQ hauled into court for hacking • The Register
[ unaccountable, free for all to hack anything that is in the domestic interest, can be corporate intelligence, trade secrets, patents, corporate documents & communications; Russia, China, Germany, Brazil, India. The NEW COLD WAR. see also 2015 BND affair with selectors. ] Government legislation to exempt GCHQ from prosecution on charges of illegal hacking has been passed and come into effect – apparently torpedoing an ongoing claim against the surveillance agency being heard by the Investigatory Powers Tribunal. Last July, a coalition of internet service providers and international organisations teamed up with Privacy International to take legal action against GCHQ. Their claim, which arrived in court today, has been hobbled by what the privacy warriors said was the revelation that the government had quietly ushered through legislation amending the Computer Misuse Act to exempt GCHQ and law enforcement from prosecution, and did so while the case was ongoing.

Secret’s death will encourage VCs to make more investments like Secret | PandoDaily
Secret’s collapse is a Harvard Business Case Study in loss mitigation. [...] VC’s are going to start flocking even harder to big-risk-big-reward deals now. Why? Because they aren’t that risky at all any more. Startups that fail quickly may now return as much as 80-90% of their capital to investors. [...] the gravity of Byttow’s decision to return the capital should not be understated. VC’s like Peter Thiel* have long advocated to take the biggest risks possible, noting that a very small percentage of deals return the majority of capital. That argument is now strengthened. So, going forward, I think there could be three major trends that emerge from the Secret story: (1) VC’s are going to start pressuring their struggling portfolio companies to return the capital rather than die a slow, pivot-filled death. (2) This will create more culture of loss mitigation, which will then encourage said VC’s to take more risk with potential breakout hits.

Here’s how reporters are reacting to Snowden’s revelations | PandoDaily
The global surveillance programs revealed by Edward Snowden have caused journalists to change how they operate, question what the government knows about them, and consider abandoning investigative reporting, according to a survey from the Pew Research Center. A significant number of the journalists surveyed said they had changed their behavior, whether it’s how they store sensitive files (49 percent), how they communicate with other journalists (29 percent), whether they’ve reached out to a source (13 percent), or pursued a specific story (2 percent). Many are also convinced the government is gathering information about them. Some 64 percent of journalists believed intelligence agencies had “probably collected data” about them. (The other 36 percent, as “InfoSec Taylor Swift” joked, must not read the news.)

With bullying app Secret on life support, investors learn the risk of investing in assholes | PandoDaily
Oh, and there’s one more lesson for investors about investing in assholes: If they seem to be heading for the door after a just a few months, you probably should do the same. At the same time as Secret asked investors to pony up $25m to fund the company’s “growth”, Byttow and his co-founder Chrys Bader-Wechseler personally cashed out $6m. That big payday came just six months after Secret launched, and less than a month before Byttow told the world he didn’t care about the victims of bullying.

Careful what you wish against: Silicon Valley just rolled out a red carpet to government regulation | PandoDaily
I never thought I’d write these words: Sometimes the public markets is the best thing that can happen to a hot company. [...] Today, Uber running a different playbook than even Facebook. First, it has controlled access to liquidity much more than Facebook ever did. But, by contrast, the company’s access to capital has been an exaggeration of Facebook’s already prodigious fundraising path. Uber has wholly embraced the notion of raising gargantuan amounts of money at jaw-dropping late stage valuations as an avenue to put off an IPO, seemingly indefinitely if it wants. That should suit a CEO like Uber’s Travis Kalanick who bristles at anyone telling him how to do his job and hates government regulation. Importantly, Uber is the first unicorn of the mobile-first era. [...] Uber’s investors have exerted no pressure on the Valley darling. [...] Reckless disregard for customers.

BBC News - MI5, MI6 and GCHQ 'spied on lawyers'
[P]olicies allowing staff to access confidential communications between lawyers and their clients, official documents have revealed. [...] An MI5 document said legally privileged material may be used "just like any other item of intelligence". [...] Families involved with the Belhaj case brought a claim to the IPT over concerns that their private discussions with legal charity Reprieve and law firm Leigh Day were being intercepted. The families have brought litigation about the kidnappings and allege that any interception of privileged communications has infringed their right to a fair trial. [...] "We hope the tribunal will tell the government in no uncertain terms that this conduct is completely unacceptable." [...] "It's now clear the intelligence agencies have been eavesdropping on lawyer-client conversations for years. "This raises troubling implications for the whole British justice system. [...] correspondence between a person and their lawyer is confidential".

Revealed: how Whisper app tracks ‘anonymous’ users | Technology | The Guardian
[ NSA & Co. served them with an order to comply, in order to watch over employees. Spotting potential Whistleblowers and leaks. Period. ] The technology, for example, enables the company to monitor all the geolocated messages sent from the Pentagon and National Security Agency. It also allows Whisper to track an individual user’s movements over time. When users have turned off their geolocation services, the company also, on a targeted, case-by-case basis, extracts their rough location from IP data emitted by their smartphone. & http://techcrunch.com/2014/10/16/whisper-suspected-of-tracking-user-info-and-sharing-it-with-the-u-s-government/ & http://pando.com/2014/10/08/twitter-sues-the-justice-department-for-the-right-to-be-honest-with-consumers/ & http://www.theguardian.com/media/2014/oct/17/-sp-whisper-tracking-location-users-facts-response

[...] behördlicher Vertuschung: "nationale Sicherheit" [...] demokratischen Gesellschaft angreift.

US Spy Programs May Break the Internet if Not Reformed, Google Leader Says | WIRED
Until the US recognizes and restores the fundamental right of ownership you have in your data, he continued, the U.S. cannot hope to rebuild trust lost through the NSA’s widespread surveillance programs. This stance flies in the face of what we expect from internet companies these days, many of whom tend to act as if they own the content we create. [...] COMPANIES HAD NO CHOICE BUT TO TAKE THE STEPS THAT APPLE AND OTHERS WERE TAKING TO STRENGTHEN THE SECURITY OF CUSTOMER DATA, AND THE GOVERNMENT SHOULD GET USED TO IT.
