The "War on Terror" in Yemen and Beyond: Legal and Ethical Implications - YouTube
USA is at war in Yemen. Is a humanitarian catastrophe. Yet another civil war in Middle East. As in Syria/Irak. And Afghanistan. Under radar screen of international community. United Nations. [bc Saudis own middle east hegemony aspirations! ... oil dollars!/petro dollars are their insurance!] [ France UK USA sell arms to SA ] Drone strikes (civilian casualties and mistaken targets) create anti-american sentiment. Saudi Arabia opposed Iran agreement deeply! Is this all "obscure." Or is it all absurd (as is life, see psychology on existentialism). Creating oh, dear (oh dearism (see Adam Curtis, throwing hands over head giving up to understand followed by covering ones eyes, ears, mouth). Bc it is easier in a selfish world where collectivism and activism has been buried under trillons of selfies and handbags for one season. [...] Another Proxy War, as in Syria (ie Iran backed Houthis, little bit overstated! but there).

Redaction error reveals FBI did target Lavabit to spy on Edward Snowden
A redaction oversight by the US government has finally confirmed that the Federal Bureau of Investigation’s targeting of secure email service Lavabit was used specifically to spy on Edward Snowden.

Ladar Levison, creator of the email service, which was founded on a basis of private communications secured by encryption and had 410,000 users, was served a sealed order in 2013 forcing him to aid the FBI in its surveillance of Snowden.

Levison was ordered to install a surveillance package on his company’s servers and later to turn over Lavabit’s encryption keys so that it would give the FBI the ability to read the most secure messages that the company offered. He was also ordered not to disclose the fact to third-parties.

Can we really trust judges to protect reporters' confidential sources? | Media | The Guardian
Journalists won’t even be safe to talk email whistleblowers from a coffee shop [...] In stressing that the powers would not be used for mass surveillance, May said the onus would be on the home office to show necessity and proportionality. And who would decide whether that was justified? Judicial commissioners, she said. They would operate a “double-lock” authorisation process on intercept and bulk interception warrants in order to prevent intrusive snooping. [ old boys club with career interests? titles, pensions? ] But will this judicial oversight provide enough protection? That’s the key worry for journalists who now know that there is nowhere for them to conceal their communications with confidential sources. U.S. and China Seek Arms Deal for Cyberspace - The New York Times
In the last year there have been devastating Chinese hacks of American computer systems, and the U.S. government has floated the idea of sanctioning China in response. Here's the apparent response: A noticeable downtick in significant hacks of American networks, and news that the U.S. and China are working on a cybersecurity arms deal, ahead of Chinese President Xi Jinping's Thursday arrival in America. The proposed agreement would supposedly prevent either nation from attacking the other's "critical infrastructure" during peacetime.

US torture doctors could face charges after report alleges post-9/11 'collusion' | Law | The Guardian
The largest association of psychologists in the United States is on the brink of a crisis, the Guardian has learned, after an independent review revealed that medical professionals lied and covered up their extensive involvement in post-9/11 torture. The revelation, puncturing years of denials, creates the potential for leadership firings, loss of licenses and even prosecutions. For more than a decade, the American Psychological Association (APA) has maintained that a strict code of ethics prohibits its more than 130,000 members to aid in the torture of detainees while simultaneously permitting involvement in military and intelligence interrogations.

Silk Road Prosecutors Ask Judge to 'Send a Message' In Ulbricht Sentencing | WIRED
[ politics involved ] Ahead of Ulbricht’s sentencing Friday, prosecutors in his case have sent the judge a 16-page letter asking that Ulbricht be given “a lengthy sentence, one substantially above the mandatory minimum.” And one of the reasons for that harsh sentence, the Department of Justice attorneys argue, is to “send a clear message” to anyone who would follow in Ulbricht’s footsteps and create the next Dark Web drug market. [...] “Although the Government has achieved some successes in combating these successor dark markets, they continue to pose investigative challenges for law enforcement,” reads the letter. “To the extent that would-be imitators may view the risk of being caught to be low, many are still likely to be deterred if the stakes are sufficiently high.” That argument ignores plenty of studies that show that long prison sentences don’t tend to deter crime. // &! bit.ly/1PVEvgk &! youtu.be/BvC9oDlT8mM &! youtu.be/weN0yyTSk4I

Lapdogs, redux: How the press tried to discredit Seymour Hersh’s bombshell reporting on CIA domestic spying | PandoDaily
According to Hersh’s account, OBL was given up by one of his Pakistani ISI prison wardens—our Pakistaini allies had been holding him captive since 2006, with backing from our Saudi allies, to use for leverage. Hersh’s account calls into question a lot of things, starting with the justification for the massive, expensive, and brutal US GWOT military-intelligence web, which apparently had zilch to do with taking out the most wanted terrorist in the world. All it took, says Hersh, was one sleazy Pakistani ISI turncoat walking into a CIA storefront in Islamabad, handing them the address to Bin Laden’s location, and picking up his $25 million bounty check. About as hi-tech as an episode of Gunsmoke.

Kaspersky claims US spies can infect computers with malware that is almost impossible to detect | PandoDaily
NSA has found a way to infect computers targeted for surveillance with malware that is almost impossible to detect and even harder to remove. Kaspersky Lab says in its report that a threat actor known as the Equation Group made this possible by infecting firmware used in hard drives made by the world’s top manufacturers. // &! President Obama Is Waging a War on Hackers | WIRED
war on whistleblower and investigative journalism. // "In next week’s State of the Union address, President Obama will propose new laws against hacking that could make either retweeting or clicking on the above (fictional) link illegal. With the help of Pinterest, Twitter, and others, a new Facebook platform wants to keep the web secure | PandoDaily
The service is called ThreatExchange, and companies like Yahoo, Twitter, and Pinterest have all agreed to share threat information with each other via the boringly-named tool. But these companies aren’t the only ones worried that information about digital threats isn’t shared as well as it could be. A new agency, the Cyber Threat Intelligence Integration Center, has been formed to facilitate similar sharing amongst various intelligence agencies. ThreatExchange and CTIIT were both formed out of the belief that digital threats are a puzzle whose pieces are held by various groups. The only way to solve that puzzle, then, is to convince everyone to share their pieces. Otherwise the puzzle will always be incomplete. // what if NSA abuses knowledge this org got (of US companies) to abuse the knowledge via FISA Court injunction not to release it to public knowledge - ie to compromise and or steal intelligence from non-US firms.

UK government asks: How's our hacking?
UK gov releases equipment interference guidelines for spy & law enforcement agencies; the guidelines never calls it hacking but 'interference activities; Deputy Director @ Privacy International Eric King (@e3i5) says it's the UK gov's attempt to grant itself some of the most intrusive powers. // "This is the first time that the agencies have admitted that they are in the hacking business," Eric King, the deputy director of London-based digital rights watchdog Privacy International, told Mashable. King said that it amounts to a belated attempt to give these activities a scrap of legal basis, in the face of a lawsuit filed by his group last year, which challenged the legality of the UK intelligence service GCHQ's hacking activities, revealed by Edward Snowden documents. For King, the document is basically an attempt by the UK government to grant itself "some of the most invasive and intrusive" powers it has at its disposal.

Here’s how reporters are reacting to Snowden’s revelations | PandoDaily
The global surveillance programs revealed by Edward Snowden have caused journalists to change how they operate, question what the government knows about them, and consider abandoning investigative reporting, according to a survey from the Pew Research Center. A significant number of the journalists surveyed said they had changed their behavior, whether it’s how they store sensitive files (49 percent), how they communicate with other journalists (29 percent), whether they’ve reached out to a source (13 percent), or pursued a specific story (2 percent). Many are also convinced the government is gathering information about them. Some 64 percent of journalists believed intelligence agencies had “probably collected data” about them. (The other 36 percent, as “InfoSec Taylor Swift” joked, must not read the news.)

The statement was made in response to questions from WikiLeaks regarding Google’s compliance with the warrant, the existence of which it didn’t reveal to its subjects until December 2014, more than two-and-a-half years after the warrant was first issued. The warrant allowed the FBI to receive metadata and the full content of any messages sent via the monitored accounts. The CIA and Homeland Security want to delete almost all their emails
If approved, all the correspondences of every person to ever be employed by the CIA will be flushed down the digital toilet three years after they leave. All messages older than seven years old will also be nuked, and only the digital missives of 22 top officials will be preserved -- something which several senators do not want to happen. [...] Funny thing is, while their plans might have been applauded by privacy advocates more than a decade ago, they're met with opposition now in light of what we've recently found out about widescale surveillance. Also, getting of rid years of correspondence from key government agencies goes against the President's promise of a more transparent and open government.

U.K. Government Points Finger Of Blame At Web Firms For Counter-Terror Failures | TechCrunch
Why is the U.K. government so vehemently targeting foreign Internet companies to adopt a more active counter-terror role? In part it draws attention away from the intelligence failures of the U.K.’s own security services, and by implication the U.K. government’s failures. While the imperative for this political rhetoric is of course ISIS and its success at appropriating Western social media channels to spread extremist propaganda. [... Snooper's Charter ...] [>>] [Abuse] So while the bill is clad in counter-terrorism justifications, the scope of its digital surveillance measures are intended to be applied more widely. And that type of ‘function creep’ for surveillance powers is something we’ve seen before — with measures ostensibly intended to bolster security service capabilities used to spy on journalists, for instance. And infringe on lawyer/client privilege. [...] United Nations [...] call on states to respect and protect the right to privacy in the digital age.

US-Verteidigungsminister Hagel: Präsident Obama sucht Nachfolger - SPIEGEL ONLINE

National Crime Agency director general: UK snooping powers are too weak | UK news | The Guardian
The UK’s top law enforcement officer says Britons must be prepared to sacrifice their freedoms online if they want to be protected from terrorists and cyber criminals. This includes giving authorities access to private email and social media contents. Speaking to The Guardian, the director general of the National Crime Agency (NCA), Keith Bristow, warned that the UK’s biggest threats are becoming increasingly focused on the web, and that authorities had not done enough to persuade the public that greater oversight of their online activity was necessary. // "The National Crime Agency was set up by the coalition to spearhead the national response to serious and organised crime. It has been called Britain’s version of America’s FBI with ministers considering giving it even greater powers and handing it the lead role in counter terrorism. It replaced the Serious and Organised Crime Agency, which was beset by problems from its birth."

Dropbox was asked not to inform users of 80% of its government data requests | PandoDaily
Many of the leaks published by the Guardian, the New York Times, the Washington Post, and ProPublica over the last few months show that companies might not even be aware of everything the government is doing to access their data. The US National Security Agency can reportedly infiltrate Google’s data through a program called MUSCULAR. Upon hearing of this program, Google engineers “exploded in profanity” and others issued a “giant Fuck You” to the NSA on their Google+ profiles. How could these companies disclose such programs in their transparency reports — even if the current restrictions are lifted — if they are unaware of them in the first place? [...] Dropbox’s transparency report is a stark reminder of just how little we still know about what information law enforcement seeks from tech companies more than a year after many of the government’s surveillance programs were first revealed.

Your iOS 8 Data is Not Beyond Law Enforcement’s Reach… Yet. | Jonathan Zdziarski's Domain
Forensics expert @JZdziarski says as long as Apple allows iOS users to share data between computers & locked devices, some user data is not safe; camera reel photos, videos & recordings are accessible along w/ iTunes media & 3rd-party app data [...] "This means that if your’e arrested, the police will seize both your iPhone and all desktop / laptop machines you own, and use files on the desktop to dump and access all of the above data on your iPhone. This can also be done at an airport, if you are detained. [...] There are a number of forensics tools capable of dumping the memory (and therefore, encryption keys) of your encrypted disk if you’ve left your computer asleep or in hibernate mode. Shut it down."
