Brian Leiter - The Death of God and the Death of Morality [Nietzsche] :: SSRN - September 16, 2015
University of Chicago -' Nietzsche famously proclaimed the "death of God," but in so doing it was not God's death that was really notable -- Nietzsche assumes that most reflective, modern readers realize that "the belief in the Christian god has become unbelievable" (GS 343) -- but the implications of that belief becoming unbelievable, namely, "how much must collapse now that this faith has been undermined," in particular, "the whole of our European morality" (GS 343). What is the connection between the death of God and the death of morality? I argue that Nietzsche thinks the death of God will undermine two central aspects of our morality: its moral egalitarianism, and its belief in moral responsibility and warranted guilt. Friedrich Albert Lange (b. 1828, d. 1875) was a German philosopher, pedagogue, political activist, and journalist. He was one of the originators of neo-Kantianism and an important figure in the founding of the Marburg school of neo-Kantianism. He also played a significant role in the German labour movement and in the development of social democratic thought. King's College London -- What unites these experiences of frustrated freedom? It is certainly not the fact that the protagonists in these examples lack the capacity for rational, intentional control over their actions or face legal impediments to their choices. Krause thus parts ways with a long tradition in western political thought dating back to Locke, Kant and Mill, which locates individual freedom in the rational will and the capacity to exercise intentional choice and control. In fact, the originality of Krause's account is showing how freedom can be undermined despite a generally friendly background of political rights and privileges that guarantee the space for intentional choice. Something subtler is going on, which is why certain dimensions of freedom have been absent from standard accounts of what it means to be free. The quality of our everyday interpersonal exchanges matters quite a lot for individual freedom because these interactions are constitutive of personal agency. Krause argues that a proper understanding of agency is inextricably tied to freedom. Following Bernard Williams, she deploys a two-dimensional conception of agency: agency consists both in deliberation and results. To be an agent is both to plan one's actions and to have a recognizable impact on the world. Agency is thus "the affirmation of one's subjective existence, or personal identity, through concrete action in the world." The efficacy dimension of agency distinguishes it from "mere willing or dreaming." (4) Crucially, however, we are not in complete control of how our actions affect the world. Their effect depends, in significant part, on how others perceive and respond to them.

(..) while our political actions are assessed against a normative principle, there is no criterion beyond the deliberative process by which the rightness of the principle is assessed; it is authoritative in virtue of being the outcome of a certain kind of deliberative process or a certain form of argument. Consequently, the challenge for constructivism is to explain the appropriateness of the process without appealing to any judgment that is supposed to derive from that process; for if the thought process relied on such a judgment to assess its appropriateness, it would assume the very thing it claims to construct. (..) a great deal of philosophical debate surrounds the appropriateness of the deliberative process, especially as it concerns the metaethical themes of justification and objectivity. (..) despite the extensive literature on the subject, there are 2 general formulations of political constructivism influenced by 2 historical accounts of practical reasons. The first is a deontological account of practical reason that is primarily associated with Kantian ethics. The second is a teleological account of practical reason that is primarily associated with social contract theory. The Kantian and social contract traditions, although offering differing accounts of practical reason, share much in common, and it would not be an exaggeration to cast constructivism as a contemporary attempt to explain the Rousseauian idea of moral freedom as acting on a law one gives oneself complemented by the Kantian idea that the law one gives oneself is out of one’s reason. Political constructivism tries to make this idea clear by identifying a compelling form of normative political analysis with easily understood criteria for thinking about political issues.

I shall today undertake in a very lengthy post to reprise what I think is my most important contribution to our understanding of Kant's theories, namely my argument that the deepest conclusions of Kant's theoretical philosophy -- his epistemology, as we would call it today -- undermine and contradict the core theses of his moral theory. The argument, which I have made in several places not much noticed by the scholarly world, is, to the best of my knowledge, original with me and has neither been anticipated nor commented upon by any other Kant scholars.

"The Modal Status of Kant's Postulate of God's Existence" by Mathew Jonathan Snow | U of Wisconsin Masters thesis (2013)
Masters thesis -- Kant is traditionally read as arguing that moral agents are rationally required to postulate the actual existence of God, but contemporary commentators' reconstructions of the argument only seem sufficient to warrant postulating the merely possible existence of God. There have been three attempts to address this seeming lacuna between what the argument is supposed to justify and what it does justify. Allen Wood defends the traditional interpretation - that Kant postulated the actual existence of God. M Jamie Ferreira proposes a revisionary interpretation - that Kant postulated the possible existence of God. Finally, Paul Guyer simply criticizes Kant for postulating the actual existence of God when his argument only justifies postulating the possible existence of God. I argue that Allen Wood's defense is insufficient to ground the appropriate propositional attitude toward the postulates while M Jamie Ferreira's proposal cannot pass as a reading of Kant. NYU School of Law, Public Law Research Paper No. 11-08 -- How should we think about, how should we model the basis of political community. To the extent that it is a matter of choice, what should be the basis on which the people of the world divide themselves up into distinct political communities. This paper seeks to cast doubt on the proposition that it is a good idea for people to form a political community exclusively with those who share with them some affinity or trust based on culture, language, religion, or ethnicity. I want to cast doubt on that proposition by articulating an alternative approach to the formation of political communities, which I shall call the principle of proximity. People should form political communities with those who are close to them in physical space, particularly those close to them whom they are otherwise like to fight or to be at odds with. This principle is rooted in the political philosophies of Hobbes and Kant. The suggestion is that we are likely to have our most frequent and most densely variegated conflicts with those with whom we are (in Kant’s words) “unavoidably side by side”, and the management of those conflicts requires not just law (which in principle can regulate even distant conflicts) but law organized densely and with great complexity under the auspices of a state. NYU School of Law, Public Law Research Paper No. 12-74 -- Theories of dignity have to navigate between two conceptions: the egalitarian idea of human dignity and the old idea of dignitas, connected with hierarchy, rank, and office. One possible way of bridging the gap between the two is to talk of the dignity of the citizen. In modern republics and democracies, the dignity of the citizen extends to a large sector of the population and connotes something about the general quality of the relation between the government and the governed. This chapter first explores Immanuel Kant’s account of the dignity of the citizen, and then it pursues the implications of the dignity of the citizen for modern society and modern theories of human dignity. NYU School of Law, Public Law Research Paper No. 11-62 -- This paper (originally presented as the Harvard Review of Philosophy Annual Guest Lecture in April 2011) explores the challenges involved in stating, characterizing and defending moral absolutes. The first part of the paper looks at the formulation of moral absolutes: must we assume that they are simple, directly prescriptive or prohibitive, not loaded with thick moral terms (as in "Do not kill the innocent"), etc? The paper compares the formulation of moral absolutes with the formulation of legal absolutes. And it considers some philosophical work on the subject, by Anscombe, Hare, Kant, and Finnis. The second part of the paper examines the ways in which moral absolutes – such as the rule against torture – deal with the burden of the humanitarian considerations arrayed against them in e.g. "ticking bomb" hypotheticals. ...the most powerful challenge is that posed by Bentham ... who imagined that torturing one person may be the only way to save hundreds of people from being tortured. -- ...opponents of torture have made things too easy for themselves in just focusing on how bad (depraved, brutal, violative, etc.) torture really is. ..., the paper indicates a number of possible lines of inquiry – one in particular involving the idea of "tainted goods," -- and a number of other lines are explored. Brian Leiter - The Case Against Free Speech (July 2014 working paper) :: SSRN
Free societies employ a variety of institutions — including courts and schools — in which speech is heavily regulated on the basis of its content ... in order to promote other desirable ends, including discovery of the truth. I illustrate this with the case of courts and rules of evidence. Three differences between courts and the polity might seem to counsel against extending that approach more widely. First, the courtroom has an official and somewhat reliable (as well as reviewable) arbiter of the epistemic merits, while the polity may not. Second, no other non-epistemic values of speech are at stake in the courtroom, whereas they are in the polity. Third, the courtroom’s jurisdiction is temporally limited in a way the polity’s may not be. I argue that only the first of these poses a serious worry about speech regulation outside select institutions like courts. I also argue for viewing "freedom of speech" like "freedom of action": speech, like everything else human beings do, can be for good or ill... and thus the central question in free speech jurisprudence should really be how to regulate speech effectively — to minimize its very real harms, without undue cost to its positive values — rather than rationalizing (often fancifully) the supposed special value of speech. In particular, I argue against autonomy-based defenses of a robust free speech principle. I conclude that the central issue in free speech jurisprudence is not about speech but about institutional competence; I offer some reasons — from the Marxist "left" and the public choice "right"— for being skeptical that capitalist democracies have the requisite competence; and make some suggestive but inconclusive remarks about how these defects might be remedied. - No of Pages: 41

I believe humans make morality in the same way they make language: it is simply the way we evolved. A linguist recognizes that every language has rules that govern correct and incorrect speech, but it is folly to ask what are the ultimately correct rules. Languages have lots in common all over the world because humans evolved a mental structure conducive to certain linguistic regularities. Similarly, humans have evolved a fairly common set of moral principles across a wide variety of forms of social organization. It is true that we speak of moral principles as right or wrong, true or false, but that does not mean that we are wedded to a "realist morality." Note that we say "the sun rises in the East and sets in the West," and this does not commit us to an earth-centric astronomy. Language is simply too flexible and subtle an instrument to treat out-of-context discourse as though they betray epistemological or ontological commitments.

Modern organizations are thought by many to exacerbate the problem of individual ethical integrity by discouraging nonconfirmity and independent judgement. Yet, studies of the effect of organizational structure on individual personality and behaviour have commonly been vague as to the precise nature of the capacities for independent ethical judgement that are endangered and about the structural and situational characteristics of organizations that threaten these capacities. This article seeks to clarify these ambiguities. Borrowing from Aristotle and more recent writers, the author develops a conception of moral autonomy that encompasses concerns about bureaucratic domination and the creation of "organization man."
